10. AMENDMENT NO. 2 TO THE AGREEMENT WITH SOUTHERN COUNTIES OIL\nCOMPANY (SC FUELS) FOR UNLEADED AND DIESEL FUEL FOR CITY VEHICLES\nPurpose: Authorize the Public Works Department to extend the existing agreement with\nSC Fuels to provide unleaded and diesel fuel to the City for fleet use through June 30,\n2025. Associated costs estimated at $500,000 per year will be included in the proposed\nFY 2023-25 budget.\nRecommended Action: 1) Approve Amendment No. 2 to the agreement with SC Fuels to\nextend the agreement term through June 30, 2025; 2) Authorize the City Manager and\nCity Attorney to make any necessary, non-monetary changes to the amendment; 3)\nAuthorize the City Manager and City Clerk to execute the amendment; and, 4) Dispense\nwith competitive bidding pursuant to Municipal Code Section 3.28.080 (H) as it is in the\nbest interest of the City to extend the existing contract for lower overall fuel costs and\nspare the expense of a competitive bidding process.

ADOPT A RESOLUTION ESTABLISHING NEW RATES FOR THE COLLECTION,\nRECYCLING, AND DISPOSAL OF REFUSE\nPurpose: Adopt a Resolution approving new rates for the collection, recycling, and\ndisposal of refuse. The projections for the proposed rate increase were included in the\nproposed FY 2023-25 budget.\nRecommended Action: 1) Adopt a resolution establishing new rates for the collection,\nrecycling, and disposal of refuse.

12. ADOPT THE 2022 ANNUAL PROGRESS REPORT (APR) ON THE STATUS AND\nPROGRESS IN IMPLEMENTING THE BUENA PARK GENERAL PLAN\nPurpose: State law requires that the City prepare an APR on the yearly status of the\nCity’s progress in implementing its General Plan. This report is in addition to the annual\nreport required for reporting on the City’s implementation of its Housing Element. There\nis no budget impact as a result of this action.\nRecommended Action: 1) Adopt the 2022 General Plan Annual Progress Report (APR)\non the status and progress in implementing the Buena Park General Plan; 2) Authorize\nthe Community and Economic Development Department to transmit the report to the\nState Department of Housing and Community Development (HCD) and the Governor’s\nOffice of Planning and Research (OPR), as required by state law; and, 3) Authorize the\nCommunity and Economic Development Department to make any changes to the report\nin response to comments received from HCD or OPR.

13. RESOLUTION APPROVING PLANS, SPECIFICATIONS, AND APPROVAL OF A\nCONTRACT WITH EXCEL PAVING FOR THE 2022-2023 ANNUAL PAVEMENT\nREHABILITATION PROJECT\nPresented by Nader M. Alqam, P.E., Associate Engineer\nPurpose: Approve plans and specifications and authorize the Public Works Department\nto hire a contractor for the 2022-2023 Annual Pavement Rehabilitation Project. This\nproject is included in the FY 2022-2023 Capital Improvements Projects budget, and will\nbe funded by the Gas Tax and Road Maintenance and Rehabilitation Account (RMRA)\nfunds (Account No. 24-9806-590004).\nRecommended Action: 1) Adopt a resolution approving the plans and specifications for\nthe 2022-2023 Annual Pavement Rehabilitation Project; 2) Award a contract to PALP,\nInc. dba Excel Paving in the amount of $1,574,970; 3) Authorize contingency funds in\nthe amount of $157,497 in the same purchase order; 4) Authorize construction\nengineering in the amount of $30,000; 5) Authorize the purchase of manhole lids for\n$37,433.05; 6) Authorize a purchase order for The Solis Group in the amount of $3,240\nfor administration of the Community Workforce Administration (CWA); 7) Approve a\nbudget transfer in the amount of $403,000 (Gas Tax funds) from the Malvern Avenue\nPavement Rehabilitation Project Account; 8) Approve a budget transfer in the amount of\n$21,000 from the Miscellaneous Sewer System Improvements Account; 9) Authorize the\nCity Manager and City Attorney to make any necessary, non-monetary changes to the\ncontract; and, 10) Authorize the City Manager and City Clerk to execute the contract.\nPUBLIC HEARING (14)

PUBLIC HEARING: RESOLUTIONS TO APPROVE AND ADOPT THE COMMUNITY\nDEVELOPMENT BLOCK GRANT (CDBG) 2023-2024 ANNUAL ACTION PLAN AND\nAMENDMENTS TO THE CITIZEN PARTICIPATION PLAN\nPresentation by Sarabeth Suarez, Housing & CDBG Analyst\nPurpose: Authorize the submission of the final CDBG 2023-2024 Annual Action Plan to\nHUD and adopt the amended Citizen Participation Plan. The Annual Action Plan\nprovides a concise summary of the actions, activities, goals, and the specific federal and\nnon-federal resources that will be used to address the City’s housing and economic\ndevelopment needs.
