10A. Public hearing to consider a timely-filed appeal (Case No. APPEAL-009901-2026) of the\nPlanning Commission’s approval for a 27-unit single-family development on a 7.188-acre\nvacant site. The project is located at 501 Ocean Bluff Way. Environmental\nConsiderations: An Environmental Impact Report (EIR) was prepared to analyze the\npotential environmental effects of the project. In accordance with the California\nEnvironmental Quality Act (CEQA), the draft EIR was published for a 45-day review\nperiod from May 16, 2025, to June 30, 2025. Comments received during the public\nreview period and corresponding responses are included in the Final EIR. Comments\nwere received from one state agency (California Department of Fish and Wildlife) and 16\nindividuals (several of whom submitted multiple comment letters). Through the analysis\nprovided in the EIR, it was determined the project would not result in significant\nenvironmental impacts with the incorporation of mitigation measures to reduce the\nenvironmental impacts to less than significant levels for: • Air quality • Biological\nResources • Cultural Resources • Noise and Vibration • Tribal Cultural Resources\nMitigation measures are identified in the EIR to reduce the environmental effects to less\nthan significant levels. Public hearing to consider an application to modify a previously approved agricultural\npermit (AG-006986-2024 and APPEAL-007854-2025/Resolution No. 2025-30) to\nestablish a community garden, allow limited small and large animal keeping, small-scale\nagricultural production, and associated agricultural uses on the subject property as\naccessory to the single-family residential use located at 3563 Fortuna Ranch Road.\nEnvironmental Considerations: The project has been determined to be exempt from\nenvironmental review pursuant to California Environmental Quality Act (CEQA)\nGuidelines Sections 15301, 15303, and 15304, which exempt operation of existing uses,\nconstruction of limited new small structures, and minor alterations of land on private\nproperty, respectively. 8H. Lease Agreement for Encinitas Fire Station #6 located at 770 Rancho Santa Fe Road.\nEnvironmental Considerations: The project is exempt from environmental review\npursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15301\n(Existing facilities) in that the proposed lease area expansion of Fire Station #6 consists\nof a minor alteration of a public facility (an existing fire station) involving negligible\nexpansion of the former use, and the construction of a new fire apparatus garage. The\nproposed lease amendment provides the City with expanded use of the subject property,\nincreasing the operational footprint of Fire Station #6 from approximately 1,310 square\nfeet to approximately 2,800 square feet (existing floor area). The expanded lease also\nincludes a new approximate 1500 square-foot apparatus garage, additional storage\nareas, full use of the parking lot, and landscaped areas. The project is also exempt from\nenvironmental review pursuant to Guidelines Section 15303 in that Section 15303 (New\nConstruction and Conversion of Small Structures) exempts the conversion of small\nstructures from one use to another where only minor modifications are made in the\nexterior of the structure and allows an exemption for the addition of accessory structures\nincluding garages. None of the exceptions in Section 15300.2 of the CEQA Guidelines\napply.
