(16) 23-1116 PERSONNEL, AUDITS, AND HIRING COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to amending Los Angeles Administrative Code (LAAC) Section 4.61 to establishing the salaries of Mechanical Helper Assistant (Class Code 3770), and Vocational Worker Mechanical Helper (Class Code 3113-H) Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: PRESENT and ADOPT the accompanying ORDINANCE, dated September 8, 2023, amending Schedule “A” of LAAC Section 4.61, to provide salaries for the new, non-represented Targeted Local Hire Program classifications of Mechanical Helper Assistant (Class Code 3770), and Vocational Worker Mechanical Helper (Class Code 3113-H), at Salary Range 2209 ($47,397.60 - $69,300.72). AUTHORIZE the City Administrative Officer (CAO), upon accretion of the classes to a bargaining unit, to amend the appropriate Memorandum of Understanding to reflect the salaries approved by Ordinance. AUTHORIZE the Controller and the CAO to correct any clerical errors, or, if approved by the City Attorney, any technical errors in the above Ordinance. INSTRUCT the CAO to report in 90 days in regard to the status of progress for hiring into these classifications.  Fiscal Impact Statement: The CAO reports that the General Fund will not be impacted in Fiscal Year 2023-24.  Departments will use vacant civil service position authorities to hire employees into these classifications.

(17) 23-0849 CD 6 MITIGATED NEGATIVE DECLARATION (MND), ADDENDUM, and RELATED CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS, PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT and ORDINANCES FIRST CONSIDERATION relative to a Zone Change, Height District Change and a Building Line Removal for the properties located at 6839 – 6845 North Woodley Avenue. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: FIND, based on the whole of the administrative record, that the Project was assessed in MND, No. ENV-2018-4247-MND adopted on February 13, 2019; and pursuant to CEQA Guidelines 15162 and 15164, as supported by the Addendum dated February 2023, no major revisions are required to the Mitigated Declaration; and no subsequent Environmental Impact Report or negative declaration is required for approval of the Project. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of Council. PRESENT and ADOPT the accompanying ORDINANCE, dated May 25, 2023, to effectuate a Zone Change from [Q]MR1-1 and [Q]P-1 to (Q)(T) M1-2D and a Height District Change from Height District 1 to Height District 2D. PRESENT and ADOPT the accompanying ORDINANCE, dated May 25, 2023, to remove a 15­-foot Building Line along Woodley Avenue for portions of the subject property, established under Ordinance No. 105,718; for the demolition of existing non­-conforming residential uses and the construction, use, and maintenance of a new three-­story self­-storage facility, the proposed building is 37 feet in height and 80,000 square feet, the building is set back approximately 70 feet from the Woodley Avenue right-­of-­way to allow for a surface parking lot as well as landscaping and trees, vehicle access is provided from one two­-way driveway from Woodley Avenue, a total of 21 parking spaces will be provided (nine within the subject site and 12 on the abutting self­-storage site to the north under the same ownership); for the properties located at 6839 – 6845 North Woodley Avenue, subject to Conditions of Approval. ADVISE the applicant, pursuant to Los Angeles Municipal Code Section 12.32 G: ....property shall not remain in a Q Qualified classification for more than six years unless during that time: (1) there is substantial physical development of the property to allow for one or more of the uses for which the Q Qualified classification was adopted; or (2) if no physical development is necessary, then the property is used for one or more of the purposes for which the Q Qualified classification was adopted... When these time limitations expire, the Q Qualified classification and the authority contained therein shall become null and void, the rezoning proceedings shall be terminated, and the property thereafter may only be utilized for those purposes permitted prior to the commencement of such rezoning proceedings. ADVISE the applicant that, pursuant to California State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring. (18) 23-0886 CD 13 SUSTAINABLE COMMUNITIES ENVIRONMENTAL ASSESSMENT (SCEA), MITIGATION MEASURES, MITIGATION MONITORING AND REPORTING PROGRAM and RELATED CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS; and PLANNING AND LAND USE MANAGEMENT (PLUM) COMMITTEE REPORT relative to a CEQA appeal filed for the properties located at 6422 West Selma Avenue, and 1540 – 1552 North Wilcox Avenue. Recommendations for Council action: FIND, pursuant to Public Resources Code (PRC), Section 21155.2, after consideration of the whole of the administrative record, including the SB 375 SCEA, No. ENV-2022-1049-SCEA, and all comments received, after imposition of all mitigation measures, there is no substantial evidence that the project will have a significant effect on the environment; FIND that the project is a “transit priority project” as defined by PRC Section 21155 and the project has incorporated all feasible mitigation measures, performance standards, or criteria set forth in prior Environmental Impact Report(s) (EIR), including Southern California Association of Governments (SCAG) 2020-2045 Regional Transportation Plan/Sustainable Communities Strategy (RTP/SCS) EIR Schedule No. 20199011061; FIND all potentially significant effects required to be identified in the initial study have been identified and analyzed in the SCEA; FIND with respect to each significant effect on the environment required to be identified in the initial study for the SCEA, changes or alterations have been required in or incorporated into the project that avoid or mitigate the significant effects to a level of insignificance or those changes or alterations are within the responsibility and jurisdiction of another public agency and have been, or can and should be, adopted by that other agency; FIND that the SCEA reflects the independent judgment and analysis of the City; FIND that the mitigation measures have been made enforceable conditions on the project; and, ADOPT the SCEA and the Mitigation Monitoring and Reporting Program prepared for the SCEA. (19) 23-1019 CD 14 PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to an Interim Control Ordinance (ICO) to prohibit the issuance of building permits for new construction of single-family residences with 2,500 square feet or more inclusive of accessory structures located in the Hillside Construction Regulation Supplemental Use District in the Northeast Community Plan area unless the proposed project completes the site plan review process, and related matters. Recommendations for Council action, pursuant to Motion (de León – Blumenfield): INSTRUCT the Department of City Planning (DCP), in consultation with the City Attorney, to prepare and present an ICO to prohibit the issuance of building permits for new construction of single-family residences with 2,500 square feet or more inclusive of accessory structures located in the Hillside Construction Regulation Supplemental Use District in the Northeast Community Plan area unless the proposed project completes the site plan review process. DIRECT the DCP that the ICO remain in effect until such time as the Code Amendment Ordinance to establish 2,500 square feet inclusive of accessory structures as the size threshold to require Site Plan Review in the Northeast Los Angeles Community Plan area is adopted and becomes effective. DIRECT the DCP to include an Urgency Clause making it effective upon publication, and consistent with California Government Code Section 65858, the ICO shall run for 45 days, with a 10-month and 15-day extension by Council Resolution, and can be further extended for an additional 1 year, or until the adoption of the appropriate land use regulatory controls have been prepared by the DCP, adopted by the Council and become effective, whichever occurs first. Fiscal Impact Statement: Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.

(21) 23-0038 HOUSING AND HOMELESSNESS and BUDGET, FINANCE, AND INNOVATION COMMITTEES’ REPORTS relative to proposed revisions and implementation recommendations for the Fiscal Year 2023-24 United to House Los Angeles (ULA) Interim Program Guidelines and Expenditure Plan. HOUSING AND HOMELESSNESS COMMITTEE REPORT Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: APPROVE the recommendations contained in the Los Angeles Housing Department (LAHD) report dated October 13, 2023, attached to the Council file. BUDGET, FINANCE AND INNOVATION COMMITTEE REPORT Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: CONCUR with the October 18, 2023 action of the Housing and Homelessness Committee.  INSTRUCT the LAHD to present to the ULA Citizen Oversight Committee on Council file No. 21-0541, the Accessible Dwelling Unit (ADU) incentive and recruitment pilot proposal, and Council file No. 21-1375, ADU Accelerator Pilot. INSTRUCT the LAHD to develop and include in the ULA permanent guidelines, programs for assisting small housing providers. Fiscal Impact Statement: The LAHD reports that there is no impact on the General Fund at this time. The recommended actions will be funded by revenue collected from the Homelessness and Housing Solutions Tax established by the ULA Measure. In the event ULA is invalidated, the City’s General Fund may be obligated to cover any spent funds. Financial Policies Statement: The CAO reports that the recommendations stated in the report are in compliance with the City’s Financial Policies in that one-time revenues will be used to fund one-time expenditures.

(26) 23-1134 CONSIDERATION OF MOTION (BLUMENFIELD – SOTO-MARTÍNEZ – YAROSLAVSKY) relative to a contract with Economic Roundtable to conduct an economic study of the formula for setting the Rent Stabilization Ordinance (RSO) annual allowable rent increase, and related matters. Recommendations for Council action: AUTHORIZE the Los Angeles Housing Department (LAHD) to negotiate and execute a sole-source contract, subject to the approval as to form by the City Attorney, with Economic Roundtable, for an amount not to exceed $180,000 from the Rent Stabilization Trust Fund No. 43/440, the term of the agreement shall be from date of execution to 12 months to conduct an economic study of the formula for setting the RSO annual allowable rent increase, with the understanding the study should conclude within three months. PROVIDE both tenants and landlords the most relevant information about their rights and responsibilities, especially as it pertains to the annual allowable rent increase, and request the concurrence of the City Attorney for a sole-source contract as the most effective means to conduct this expedited economic study of the formula for setting the RSO annual allowable rent increase, due to the continuing state of emergency on housing and homelessness, and in order to prevent wrongful evictions and further tenant displacement, upon the lifting of the City’s COVID-19 protections that will expire on January 31, 2024. FIND that the services to be performed by Economic Roundtable are for the performance of professional, scientific, expert, technical, or other special services of a temporary and occasional character for which competitive bidding is not practicable or advantageous and that the work can be performed more economically or feasibly by independent contractors than by City employees. INSTRUCT the LAHD to include in the economic study, authorized by Council File 21-0042-S3, an analysis of the impacts on homelessness in the City of Los Angeles, including the analysis from the 2020 U.S. Government Accountability Office study around median rent increases, for any recommended allowable rent increase caps and formulas.
