FIND that the City cannot continue funding the RBR Program.\n2. INSTRUCT the Bureau of Sanitation (BOS) to:\na. Terminate the RBR Program provision of the RecycLA\npersonal services contracts for exclusive franchise\ncommercial and multi-family solid resources collecting and\nhauling for all 11 zones Citywide, encompassing the\nfollowing agreements:\ni. Arakelian Enterprises, Inc. dba Athens Services (C-\n128879)\nii. Consolidated Disposal Service, LLC dba Republic\nServices (C-128880)\niii. Universal Waste Systems, Inc. (UWS) (C-128881)\niv. Provide written notice of termination to the RecycLA\nservice providers with termination of the RBR to occur on\nJanuary 31, 2027, upon the anticipated expiration date of\nthe current contracts listed above, with notice to occur at\nleast one calendar year prior to the effective termination\ndate.\nc. Complete all audits of the RBR Program, address any\ndiscrepancies including any reimbursements owed to the\nCity, issue liquidated damages as appropriate, and pursue\nthe resolution of outstanding liquidated damages owed by\ncurrent RecycLA service providers through the RBR\npayment reconciliation process and other means, as\nnecessary, prior to the termination of the contracts on\nJanuary 31, 2027.\nFiscal Impact Statement: The City Administrative Officer (CAO)\nreports that adoption of the above recommendations would activate a\nrequired one-year notice period for RecycLA service providers to\nterminate the RBR Program by January 31, 2027 and could mitigate\ncosts to the Citywide Recycling Trust Fund (CRTF) by up to $2.49\nmillion per month should new waste collection contracts not be in\nplace by February 1, 2027, which may then result in an equal amount\nof savings to the General Fund in reduced subsidies and\nappropriations required to support CRTF obligations in 2026-27.\nAdoption of the above recommendation to instruct the BOS to seek\nany owed reimbursements and resolve outstanding liquidated\ndamages due to the City prior to the expiration of the current RecycLA\ncontracts may result in additional revenue to the CRTF and further\nreduce its reliance on the General Fund, impacts of which are\nunknown at this time.\nFinancial Policies Statement: The CAO reports that the above\nrecommendations pursue compliance with the City's Financial\nPolicies in that, to the extent possible, current operations will be\nfunded by current revenues, and that special funds are to reimburse\nthe General Fund for all direct expenditures and related costs\nprovided to support their programs.

TRANSFER and APPROPRIATE $210,000 from the Measure M\nLocal Return Special Fund No. 59C-94, Account No. 94YG25\n(Vision Zero Corridor Projects), to the Department of\nTransportation Fund No. 100/94 for completion of the plan\ncheck and review process on the Western Our Way Project, as\nfollows:\na. Account No. 001010 (Salaries General) - $175,000\nb. Account No. 001090 (Salaries Overtime) - $35,000\n2. (14)\n25-1516\nCOMMUNICATION FROM THE CITY ADMINISTRATIVE OFFICER\nrelative to amending Chapter 14 – Deferred Compensation Plan, of the\nLos Angeles Administrative Code (LAAC) to allow for an employer\ncontribution to an employee’s Deferred Compensation Plan 457(b)\nretirement savings account.\nRecommendation for Council action:\nREQUEST the City Attorney to prepare and present an Ordinance\namending Chapter 14 – Deferred Compensation Plan, of the LAAC to\nallow for an employer contribution to an employee’s Deferred\nCompensation Plan 457(b) retirement savings account.\nFiscal Impact Statement: The City Administrative Officer reports that\ndeveloping the details of the proposed Plan amendment and\nassociated implementation steps will cost an estimated $250,000,\nincluding set up and reprogramming fees to the Plan record keeper,\nconsulting costs, and staffing reimbursement expenses. The Los\nAngeles Department of Water and Power (LADWP) has pledged to\ncontribute $150,000, with the difference coming from the General\nFund. The General Fund will not be impacted beyond the preparation\nof Plan design changes and initial implementation steps; once the\nemployer contribution feature is enacted, expenses will be part of\nongoing operating costs for the Plan. The funds for the employer\ncontribution amounts themselves will be borne solely by LADWP.

DETERMINE that the proposed project is categorically exempt\nfrom the provisions of the California Environmental Quality Act\n(CEQA) pursuant to Article 19, Section 15301 (Operation,\nrepair, maintenance, permitting, leasing, licensing, or minor\nalteration of existing public or private structures, facilities,\nmechanical equipment, or topographical features, involving\nnegligible or no expansion of existing or former use) of the\nCalifornia CEQA Guidelines; and, Article III, Section 1, Class\n1(14) of the City CEQA Guidelines.\n2. APPROVE a proposed five-year MOU, with one five-year option\nto extend at the discretion of the General Manager, RAP, or\ndesignee, between the City of Los Angeles, acting by and\nthrough the Board of Recreation and Park Commissioners\n(Board), and Friends of Oakridge (Organization) in support of\nthe restoration and preservation of the Oakridge Estate\nResidence located at 18650 Devonshire Street, Northridge,\nCalifornia 91324, substantially in the form as Attachment 1 of\nthe Board report dated December 18, 2025, attached to the\nCouncil file.\n3. AUTHORIZE the President and Secretary, Board, to execute\nthe MOU subsequent to all necessary approvals.\n4. AUTHORIZE the RAP to make any necessary technical\nchanges consistent with the Board’s intent in approving said\nBoard report and proposed MOU.\nFiscal Impact Statement: The Board reports that the proposed MOU\nwill have no adverse impact on RAP’s General Fund as operations\nand program costs associated with the Organization's use and\nsupport of the Oakridge Estate Residence and Park will be paid for by\nthe Organization at no cost to the City or the RAP.

(6)\n25-1533\nARTS, PARKS, LIBRARIES, AND COMMUNITY ENRICHMENT\nCOMMITTEE REPORT and RESOLUTION relative to the initiation\nof proceedings for the 2026-27 Proposition K Assessment.\nRecommendation for Council action:\nADOPT the accompanying RESOLUTION to Initiate Proceedings for\nthe 2026-27 Proposition K assessment, attached to the Proposition K\n– L.A. For Kids Steering Committee (LAFKSC) report dated\nDecember 11, 2025, attached to the Council file, which instructs the\nCity Engineer to present a report to the Council which describes the\nacquisition and capital improvements to parks and recreational and\ncommunity facilities serving youth citywide to be undertaken in the\nupcoming fiscal year, pursuant to the Landscaping and Lighting Act of\n1972.\nFiscal Impact Statement: The LAFKSC reports that approval of the\nrecommended action will initiate proceedings to levy the annual $25\nmillion Proposition K assessment which will be used to fund\nacquisitions and capital improvements to parks and recreational and\ncommunity facilities serving youth citywide.

DETERMINE the following:\na. The proposed action is exempt from the California\nEnvironmental Quality Act (CEQA) under Section 15301 of\nthe State CEQA Guidelines and Section 1(a) of Article III\nof the City CEQA Guidelines, in that the project involves\nthe minor alteration of an existing public facility with\nnegligible or no expansion of its current use.\nb. The proposed action is exempt pursuant to State CEQA\nGuidelines Section 15323, as its action consists of the\nnormal operation of existing facilities for public gatherings\nfor which the facility was designed.\nc. The proposed action does not constitute a project under\nCEQA pursuant to State CEQA Guidelines Section\n15378(b), in that the action relates merely to\nadministrative and organizational matters and the setting\nof policy and procedures that do not result in any direct or\nindirect change to the physical environment.\n2.
