SECOND READING AND ADOPTION OF ORDINANCES INCREASING THE AMOUNT OF\nWATER AND WASTEWATER (SEWER) RATES AND CHARGES\nIt is recommended that the City Council consider:\n(1) Waiving second reading and adopting the proposed Ordinance No. #### – Increasing\nthe amount of Water Rates and Charges;\n(2) Waiving second reading and adopting the proposed Ordinance No. #### – Increasing\nthe amount of Wastewater Rates and Charges; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThis Ordinance is exempt from review under the California Environmental Quality Act (Cal. Pub.\nRes. Code §§ 21000, et seq.; “CEQA") and CEQA regulations (14 Cal. Code Regs. §§ 15000, et\nseq.; “CEQA Guidelines”) because it establishes, modifies, structures, restructures, and approves\nrates and charges for meeting operating expenses; purchasing supplies, equipment, and\nmaterials; meeting financial requirements; and obtaining funds for capital projects needed to\nmaintain service within existing service areas. This Ordinance, therefore, is categorically exempt\nfrom further CEQA review under CEQA Guidelines § 15273;

ENDING THE EMPLOYMENT EMERGENCY FOR THE CITY OF MONTEREY PARK\nEFFECTIVE DECEMBER 31, 2023\nIt is recommended that the City Council consider:\n(1) Receiving and filing this report;\n(2) Adopting a resolution terminating the employment emergency effective December 31,\n2023 and authorizing the City Manager to take all practical actions needed to finalize the\nrecruitment and retention of persons for employment; and\n(3) Taking such additional, related, action that may be desirable.

ZC-23-02 (“ZC-23-02”), AN ORDINANCE AMENDING THE ZONING MAP\nFOR CERTAIN PROPERTIES FOR CONSISTENCY WITH THE GENERAL PLAN, LAND\nUSE AND URBAN DESIGN ELEMENT\nIt is recommended that the City Council consider:\n(1) Opening a public hearing and taking testimonial and documentary evidence;\n(2) After closing the public hearing and considering the evidence submitted during that public\nhearing, introducing and waiving first reading of Ordinance No. _____ amending the\nzoning map for certain properties for consistency with the General Plan, Land Use and\nUrban Design Element; and\n(3) Taking such additional, related, action that may be desirable.

A PUBLIC HEARING TO CONSIDER POSSIBLE ACTION REGARDING ZONING\nCODE AMENDMENT NO. 23-05 (ZCA-23-05) TO COMPLY WITH CALIFORNIA LAW\nREGARDING MEDICAL CANNABIS DELIVERY RETAILERS\nIt is recommended that the City Council consider:\n(1) Opening a public hearing and taking testimonial and documentary evidence;\n(2) After receiving verbal and written testimony, close the public hearing;\n(3) After discussing the evidence, adopt Urgency Ordinance No. _____ amending Monterey\nPark Municipal Code (“MPMC”) Chapter 6.35 (Commercial Cannabis Activities) and\nadding Chapters 6.36 (Medical Cannabis Delivery) and 21.27 (Cannabis-Related Uses);\nand\n(4) Introduce and waive first reading of an Ordinance amending MPMC Chapter 6.35\n(Commercial Cannabis Activities) and adding Chapters 6.36 (Medical Cannabis Delivery)\nand 21.27 (Cannabis-Related Uses). Second reading and adoption would occur on\nJanuary 17, 2024; and\n(5) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of this proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the\nregulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). No additional environmental review is required for this Ordinance pursuant to CEQA\nGuidelines § 15060(c)(2), § 15378(b)(5) § 15301 § 15303 and §15061(b)(3). The proposed\nOrdinance is exempt from CEQA because it is a zoning text amendment which permits delivery\nof medical cannabis in the City’s commercial zone, which will not have a direct or reasonably\nforeseeable indirect physical change in the environment and does not qualify as a “project” under\nCEQA because it will not make physical changes to the environment. The proposed Ordinance is\nalso exempt pursuant to CEQA Guidelines § 15301 and 15303 for activities that involve negligible\nor no expansion of use for existing facilities and for the conversion of existing small structure for\nanother use. Finally, the proposed Ordinance is exempt from CEQA under the common sense\nexemption that it will not affect the environment.

AN ORDINANCE INCORPORATING BY REFERENCE CHAPTER 7.46 OF LOS ANGELES\nCOUNTY CODE TITLE 7 – BUSINESS LICENSES INTO A NEW CHAPTER 5.90 OF THE\nMONTEREY PARK MUNICIPAL CODE (“MPMC”)\nIt is recommended that the City Council consider:\n(1) Introducing and waiving first reading, and continuing the scheduled public hearing from\nDecember 20, 2023 to January 17, 2024 (pursuant to Government Code § 50022.3) to\nadopt an Ordinance that would incorporate by reference Los Angeles County Code Title\n7, Chapter 7.46 regarding the regulation of gun dealers within the City of Monterey Park\n(“City”); and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThis Ordinance is exempt from review under the California Environmental Quality Act (California\nPublic Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (14 California Code of\nRegulations §§ 15000, et seq.) in that it is not a “project” for purposes of CEQA, as that term is\ndefined by CEQA Guidelines § 15378. Specifically, this Ordinance constitutes creation of\ngovernment regulations which do not involve any commitment to any specific project which may\nresult in a potentially significant physical impact on the environment. In addition, this Ordinance\nis an organizational or administrative activity that will not result in a direct or indirect physical\nchange in the environment.
