CONTRACT AWARD TO TORO ENTERPRISES INC., FOR ANNUAL CITYWIDE STREET RESURFACING AND\nADA IMPROVEMENT PROGRAM, FISCAL YEAR 2023 AND FISCAL YEAR 2024 COMBINED FOR AN\nAMOUNT NOT-TO-EXCEED $8,877,539 (Public Works Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find the contract proposed in the agenda report to be categorically exempt under the California Environmental\nQuality Act (CEQA) Guidelines in accordance with Title 14, Chapter 3, Article 19, Section 15301, Class 1, and\nSection 15303, Class 3, and that there are no features that distinguish this project from others in the exempt classes,\nand therefore, there are no unusual circumstances; and\n(2) Accept the bid dated May 18, 2023, submitted by Toro Enterprises Inc., in response to the plans and\nspecifications for Annual Citywide Street Resurfacing and ADA Improvement Program, FY2023 and FY2024, reject all other\nbids received, and authorize the City Manager to enter into a contract for an amount not-to-exceed $8,877,539, which\nincludes the base contract amount and a contingency of $422,740 to provide for any necessary change orders.

AUTHORIZATION AMEND CITY CONTRACT NO. 32286 WITH RICHARD ROSENTHAL, PHD FOR\nINDEPENDENT POLICE AUDITOR SERVICES, TO INCREASE THE NOT-TO-EXCEED AMOUNT BY $150,000, AND\nTO EXTEND THE CONTRACT TERM BY 1 YEAR\nRecommendation: It is recommended that the City Council:\n(1) Find that the proposed action is not a project subject to the California Environmental Quality Act (CEQA)\npursuant to Section 21065 of CEQA and Sections 15060(c)(2), 15060(c)(3), and 15378 of the State CEQA Guidelines,\nand as such, no environmental document pursuant to CEQA is required;\n(2) Authorize the City Attorney to amend city contract no.32286 with Richard Rosenthal, PhD for independent\npolice auditor services, to increase the contract amount by $150,000, and to extend the contract term by one year: and\n(3) To the extent this could be considered a separate procurement subject to the Competitive Selection Process, it\nis recommended that the City Council grant the contract an exemption pursuant to Pasadena Municipal Code\n(PMC) Section 4.08.049(B), contracts for which the City’s best interests are served.\nAdvisory Bodies

ADOPTION OF RESOLUTION FOR THE RECREATIONAL TRAILS PROGRAM (RTP) GRANT FOR THE ARROYO\nCRITICAL LINKAGES PROJECT\n(PRCS Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find that the proposed action in the agenda report is categorically exempt from the California Environmental\nQuality Act (“CEQA”) in accordance with CEQA Guidelines Article 19, Sections 15301, Existing Facilities, 15304\nMinor Alterations to Land, and 15311 Accessory Structures, and that there are no features that distinguish the project\nfrom others in the exempt class, and therefore, there are no unusual circumstances;\n(2) Adopt a resolution authorizing the City submit a grant application for the Recreational Trails Program in the\namount of $500,000 for the planning and construction of the One Arroyo Critical Linkages Project; and\n(3) Authorize the City Manager or his designee to approve any documents in connection with the RTP grant\napplication or, in the event that the City receives an award, any RTP grant contract documents that may be required by the\nState of California.\nRESOLUTION

AUTHORIZATION TO ENTER INTO MEMORANDUM OF AGREEMENT BETWEEN CITY OF PASADENA, SAN\nGABRIEL VALLEY COUNCIL OF GOVERNMENTS, 17 PUBLIC AGENCIES AND LOS ANGELES COUNTY\nFLOOD CONTROL DISTRICT FOR ADMINISTRATION AND COST SHARING FOR IMPLEMENTATION OF THE\nCOORDINATED INTEGRATED MONITORING AND THE WATERSHED MANAGEMENT PROGRAMS FOR\nTHE UPPER LOS ANGELES RIVER WATERSHED FOR AN AMOUNT NOT-TO-EXCEED $244,588 (Public Works\nDept.)\nRecommendation: It is recommended that the City Council:\n(1) Find the Memorandum of Agreement (MOA) proposed in the agenda report to be exempt from the California\nEnvironmental Quality Act (CEQA) in accordance with Title 14 Chapter 3, Article 19, Section 15308, Class 8, actions\ntaken by regulatory agencies to assure the maintenance, restoration, enhancement, or protection of the environment;\nand\n(2) Authorize the City Manager to execute a Memorandum of Agreement (MOA) between City of Pasadena, San\nGabriel Valley Council of Governments (SGVCOG), 17 other public agencies and Los Angeles County Flood Control\nDivision (LACFCD) regarding the administration and cost sharing for implementing the Coordinated Integrated\nMonitoring Program (CIMP) and the Watershed Management Program (WMP) for the Upper Los Angeles River (ULAR)\nWatershed Management Area (WMA) for an amount not-to-exceed $244,588.

AUTHORIZE ISSUANCE OF A PURCHASE ORDER WITH TOTER, LLC FOR THE PURCHASE OF 7,000\nROTATIONAL MOLDED AUTOMATED REFUSE CONTAINERS IN AN AMOUNT NOT-TO- EXCEED $375,000\nFOR ONE YEAR (Public Works Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find that the proposed action is exempt from the California Environmental Quality Act (“CEQA”) pursuant to\nState CEQA Guidelines Section 15061(b)(3) “Common-Sense” exemption; and\n(2) Authorize the issuance of a purchase order to Toter, LLC for the purchase of 7,000 rotational molded automated\nrefuse containers for an amount not-to-exceed $375,000 as neither Competitive Bidding nor Competitive\nSelection are required pursuant to City Charter Section 1002(H) and Pasadena Municipal Code Section 4.08.049(A)\n(3), contracts with other governmental entities.

AUTHORIZATION TO ENTER INTO A CONTRACT WITH SWIFT LEE OFFICE INC., FOR PROFESSIONAL\nARCHITECTURAL AND DESIGN SERVICES FOR THE POLICE DEPARTMENT AIR OPERATIONS AIRCRAFT\nHANGAR FOR AN AMOUNT NOT-TO-EXCEED $232,500 (Public Works Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find the contract proposed in the agenda report to be categorically exempt under the California Environmental\nQuality Act (CEQA) in accordance with Title 14, Chapter 3, Article 19, Section 15061(b)(3), the “Common-Sense”\nexemption that CEQA applies only to projects which have the potential for causing a significant effect on the\nenvironment; and\n(2) Authorize the City Manager to enter into a contract, as the result of a competitive selection process, as specified\nby Section 4.08.047 of the Pasadena Municipal Code, with Swift Lee Office Inc., for Professional Architectural and\nDesign Services for the Pasadena Police Department Air Operations Aircraft Hangar in an amount not-to-exceed\n$232,500, which includes the base contract amount of $202,175 and a contingency of $30,325 to provide for any\nnecessary change orders. Competitive price bidding is not required pursuant to City Charter Section 1002(F)\n(Contracts for Professional or Unique Services).

CONTRACT AWARD TO MLC CONSTRUCTORS INC., FOR A PREFABRICATED STORAGE BUILDING AT FIRE\nSTATION 33 FOR AN AMOUNT NOT-TO-EXCEED $498,190 (Public Works Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find the contract proposed in the agenda report to be categorically exempt under the California Environmental\nQuality Act (CEQA) pursuant to Title 14, Chapter 3, Article 19, Section 15311, Class 11 – Accessory Structures,\nand that there are no features that distinguish this project from others in the exempt class, and therefore, there are no\nunusual circumstances; and\n(2) Accept the bid dated April 20, 2023, submitted by MLC Constructors Inc., in response to the plans and\nspecifications for the Fire Station 33 Prefabricated Storage Building project, reject all other bids received, and authorize the\nCity Manager to enter into a contract for an amount not-to-exceed $498,190, which includes the base contract amount\nof $452,900 and a contingency of $45,290 to provide for any necessary change orders.

AUTORIZATION TO AMEND PURCHASE ORDER NO. 1231124 WITH WILLIAMS SCOTSMAN INC., TO\nINCREASE AMOUNT BY $68,000 FOR A TOTAL AMOUNT NOT-TO-EXCEED $301,662 FOR THE LEASE OF\nMODULAR TRAILERS FOR TEMPORARY RELOCATION OF FIRE STATION 31 (Public Works Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find the contract proposed in the agenda report to be categorically exempt under the California Environmental\nQuality Act (CEQA) in accordance with Title 14, Chapter 3, Article 19, Section 15061(b)(3), the “Common-Sense”\nexemption that CEQA applies only to projects which have the potential for causing a significant effect on the\nenvironment;\n(2) Authorize the City Manager to amend Purchase Order No. 1231124 with Williams Scotsman Inc., to increase\namount by $68,000 for a total amount not-to-exceed $301,662 for the lease of modular trailers for temporary\nrelocation of Fire Station 31; and\n(3) To the extent this transaction could be considered a separate procurement subject to the Competitive Selection\nProcess, grant the proposed contract amendment with Williams Scotsman Inc., an exemption from the Competitive\nSelection Process set forth in the Competitive Bidding and Purchasing Ordinance pursuant to the Pasadena Municipal\nCode Section 4.08.049(B), contracts where the best interests of the City are served and City Charter Section\n1002(C), contracts for labor, material, supplies, or services available from only one vendor.

AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH LOS ANGELES COUNTY DEPARTMENT OF PUBLIC\nWORKS FOR STREET IMPROVEMENTS WITHIN CITY’S RIGHT-OF-WAY ON NORTH ALTADENA\nDRIVE AND EAST WASHINGTON BOULEVARD WITH THE CITY’S SHARE AMOUNT ESTIMATED AT $880,000\n(Public Works Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find the contract proposed in the agenda report to be categorically exempt under the California Environmental\nQuality Act (CEQA) Guidelines in accordance with Title 14, Chapter 3, Article 19, Section 15301, Class 1, and\nSection 15303, Class 3, and that there are no features that distinguish this project from others in the exempt classes,\nand therefore, there are no unusual circumstances; and\n(2) Authorize the City Manager to execute an agreement with Los Angeles County Department of Public Works for\nfinancial responsibilities within City’s right-of-way for the street improvements on North Altadena Drive and East\nWashington Boulevard with a City’s share amount estimated at $880,000.

AUTHORIZATION TO ENTER INTO A CONTRACT WITH THE LOS ANGELES COUNTY SHERIFF’S\nDEPARTMENT TO PROVIDE INMATE MEALS FOR THE PASADENA CITY JAIL (Police Dept.)\nRecommendation: It is recommended that the City Council:\n(1) Find that the project proposed in the agenda report is exempt under the California Environmental Quality Act\n(CEQA) Guidelines Section 15061(b)(3), the “Common-Sense” exemption that CEQA applies only to projects that\nmay have an effect on the environment;\n(2) Authorize the issuance of a five-year contract with the Los Angeles County Sheriff’s Department, without\ncompetitive bidding pursuant to City Charter Section 1002(H), contracts with other governmental entities or their\ncontractors for labor, materials, supplies or services in an amount not-to-exceed $125,000; and\n(3) Grant the proposed contract an exemption for the competitive selection process of the Competitive Bidding and\nPurchasing Ordinance, pursuant to Pasadena Municipal Code Section 4.08.049(B), contracts with other\ngovernmental agencies and contracts for which the City’s best interests are served.
