11. ACCEPTANCE OF GOLF COURSE RENOVATION PROJECT PHASE 3 (CP NO. 894-3) – NOTICE OF\nCOMPLETION\nRECOMMENDATION: It is recommended that the City Council:\n1. Accept the Golf Course Renovation Project Phase 3 (CP No. 894-3) as completed by Robert Clapper\nConstruction Services, Inc. dba R.C. Construction Services;\n2. Approve the final contract amount with R.C. Construction Services for the construction of the Project in\nthe amount of $12,773,515.80 including change orders;\n3. Approve the Final Total Project Budget (Attachment A);\n4. Authorize the City Clerk to execute, verify and file the Notice of Completion (Attachment B) with the Los\nAngeles County Registrar-Recorder;\n5. Authorize the City Manager to release the retention payment of $638,675.80 due to R.C. Construction\nServices following the mandatory waiting period from the date the Notice of Completion is recorded;\n6. Amend the Fiscal Year 2024-25 budget by increasing appropriations by $376,316 in Fund 310 (Golf\nCourse Renovation Project); and\n7. Take such additional, related, action that may be desirable.

14. AWARD ON-CALL BENCHLIST ARCHITECTURAL AND ENGINEERING PROFESSIONAL SERVICES\nAGREEMENTS\nRECOMMENDATION: It is recommended that the City Council:\n1. Approve and authorize the City Manager to execute a professional services agreement with CWE for\nengineering services and stormwater management program services in compliance with Federal, State\nand County regulations for the not-to-exceed annual amount of Two-Hundred Thousand Dollars\n($200,000) payable from a combination of Safe Clean Water Measure W funds and the City’s portion of\nMetro Measure M/R funds; and\n2. Approve and authorize the City Manager to execute a professional services agreement with Infrastructure\nArchitects, Inc., for architectural and engineering services for the not-to-exceed annual amount of Seven\nHundred Fifty Thousand Dollars ($750,000) payable from a combination of City’s portion of Metro\nProposition A/C and Measure M/R funds, Parks & Recreation Measure A funds, Community Development\nBlock Grant (CDBG) funds, and State Road Maintenance and Rehabilitation Account (RMRA), also\nknown as Senate Bill 1 funds; and\n3. Approve and authorize the City Manager to execute a professional services agreement with Bowman\nConsulting Group Ltd., for staff augmentation and engineering design services for the not-to-exceed\nannual amount of Two Million Dollars ($2,000,000) payable from a combination of City’s portion of Metro\nProposition A/C and Measure M/R funds, and State Road Maintenance and Rehabilitation Account\n(RMRA), also known as Senate Bill 1 funds; and\n4. Approve and authorize the City Manager to execute a professional services agreement with Ladayu\nConsulting Group for construction management and inspection services for the not-to-exceed annual\namount of Three Hundred Thousand Dollars ($300,000) payable from a combination of City’s portion of\nMetro Proposition A/C and Measure M/R funds, and State Road Maintenance and Rehabilitation Account\n(RMRA), also known as Senate Bill 1 funds; and\n5. APPROVE RESOLUTION NO. 24-84 EASTSIDE TRANSIT CORRIDOR PHASE 2 PROJECT (“ESP2\nPROJECT”) COOPERATIVE AGREEMENT WITH THE LOS ANGELES COUNTY METROPOLITAN\nTRANSPORTATION AUTHORITY (“LACMTA”)\nRECOMMENDATION: It is recommended that the City Council:\n1. Adopt Resolution No. 24-84, approving the cooperative agreement (MCA) by and between the City of\nMontebello (City) and LACMTA related to the ESP2 Project; and\n2. Authorize the City Manager to execute the cooperative agreement; and\n3. Take such additional, related action that may be desirable.

APPROVE RESOLUTION NO. 24-82 ADOPTING CALTRANS’ WRITTEN POLICY ON LOCAL ASSISTANCE\nPROCEDURES MANUAL CHAPTER 10: CONSULTANT SELECTION AS A CONDITION OF APPROVAL TO\nRECEIVE FEDERAL CALL FOR PROJECT GRANT FUNDING\nRECOMMENDATION: It is recommended that the City Council:\n1. Adopt Resolution No. 24-82 adopting the California Department of Transportation’s (Caltrans) written\npolicy on Local Assistance Procedure Manual (LAPM) Chapter 10: Consultant Selection as a condition\nof approval to receive Federal Call for Project (CFP) grant funding; and,\n2. Take such additional, related action that may be desirable.

Adopt Resolution No. 24-83, designating the City Manager and the Public Works Director as the\nauthorized personnel to execute Federal and State agreements, documents, and exhibits in compliance\nwith Chapter 16.2 of the State of California Department of Transportation (Caltrans) Local Assistance\nProcedures Manual and City Council adopted Capital Improvement Program Projects; and,\n2. 18. APPROVE AWARD OF PROFESSIONAL SERVICES AGREEMENT NO. 4245 TO VERDE FACILITIES\nSERVICES, LLC TO PROVIDE CITYWIDE CUSTODIAL SERVICES\nRECOMMENDATION: It is recommended that the City Council:\n1. Award Professional Services Agreement No. 4245 to Verde Facilities Services to provide generator\nmaintenance and repair services for an initial three (3) year term in a not-to-exceed amount of\n$1,849,506.96; and\n2. Amend the Fiscal Year 2024-25 Budget by increasing appropriations by $20,000 in Account No. 100-30-\n510-6040.35 (General-Public Works-Government Building Maintenance-Contract Services Custodial\nServices) for porter services and by $10,000 in Account 610-99-6040.35 (Golf-Non-Departmental-\nContract Services Custodial Services); and\n3. Reject all other proposals; and\n4. Authorize the City Manager to execute the professional services agreement; and\n5. Take such additional, related action that may be desirable.

20. AWARD A CONSTRUCTION CONTRACT TO ESTATE DESIGN AND CONSTRUCTION, INC. FOR THE DOG\nPARK AT ACUÑA PARK (CP 922)\nRECOMMENDATION: It is recommended that the City Council:\n1. Award a construction contract to Estate Design and Construction, Inc. for the dog park at Acuña Park\n(CP 922) in the amount of $632,071 plus a 10% construction contingency of $63,207 for a total contract\namount of $695,278; and\n2. Authorize the City Clerk’s Office to release all other bidders’ bonds; and\n3. Authorize the City Manager to execute the construction contract and all change orders in good faith; and\n4. Take such additional, related action that may be desirable.

ADOPT RESOLUTION NO. 24-77 AUTHORIZING USE OF FUNDING FROM THE SOUTHERN CALIFORNIA\nASSOCIATION OF GOVERNMENTS (SCAG) REGIONAL EARLY ACTION PLANNING GRANT PROGRAM\nOF 2021 FOR THE MONTEBELLO TRANSFORMATIVE CORRIDORS ENHANCED INFRASTRUCTURE\nFINANCING DISTRICT (EIFD) FEASIBILITY STUDY\nRECOMMENDATION: It is recommended that the City Council:\n1. Adopt Resolution No. 24-77 authorizing participation in the Southern California Association of\nGovernments (SCAG) Regional Early Action Planning Grant Program of 2021 for the Montebello\nTransformative Corridors Enhanced Infrastructure Financing District (EIFD) Feasibility Study; and\n2. Authorize the City Manager to execute an agreement and all necessary documents related to the\nSouthern California Association of Governments (SCAG) Early Action Planning Grant Program of 2021\nfor the Montebello Transformative Corridors Enhanced Infrastructure Financing District (EIFD) Feasibility\nStudy; and\n3. Take such additional, related action that may be desirable.

22. APPROVE THE SECOND AMENDMENT TO COMMERCIAL CANNABIS BUSINESS DEVELOPMENT\nAGREEMENT NO. 23-19\nRECOMMENDATION: It is recommended that the City Council:\n1. Approve a Second Amendment to Cannabis Business Development Agreement No. 23-19 (“Second\nAmendment”) to allow a change of business name and ownership for cannabis business located at 7733\nTelegraph Road, in a form approved by the City Attorney’s Office; and\n2. Adopt findings contained herein exempting the Second Amendment from further California Environmental\nQuality Act (CEQA) review under CEQA Sections 15301 and 15061 and direct staff to prepare and file\nthe applicable Notice of Exemption for the project recommended for approval; and\n3. Take such additional, related action that may be desirable, and/or provided the City Attorney's office\nand/or staff with additional or alternative directive(s).

23. AUTHORIZE RECEIPT OF GRANT AWARD FROM DEPARTMENT OF JUSTICE PROPOSITION 56\nTOBACCO GRANT AWARD FUNDING\nRECOMMENDATION: It is recommended that the City Council:\n1. Approve the acceptance of $317,181 in grant funds awarded to the City by the Department of Justice\n(DOJ) Proposition 56 Tobacco Grant program; and\n2. Authorize the City Manager to negotiate and execute any documents or agreements, and any\namendments thereto, necessary for the City’s participation in the Proposition 56 Tobacco Grant program;\nand\n3. Amend the Fiscal Year 2024-25 budget by increasing appropriations by $317,181 in Account No. 251-\n50-531-5000.10 (Tobacco Grant Program, Community Development, Tobacco Grant Program, Regular\nSalaries [expenditures]) and $317,181 in Account No. 251-99-4198.50 (Tobacco Grant Program,\nMiscellaneous Grants, Tobacco Grant Program [revenue]); and\n4. Take such additional, related, action that may be desirable.

24. APPROVE THE SECOND AMENDMENT TO COMMERCIAL CANNABIS BUSINESS DEVELOPMENT\nAGREEMENT NO. 16-19\nRECOMMENDATION: It is recommended that the City Council:\n1. Approve the Second Amendment to Cannabis Business Development Agreement No. 16-19 (“Second\nAmendment”) to increase the square footage of the current cannabis cultivation operations in the City of\nMontebello, and authorize the City Attorney’s Office to make final and technical edits or revisions, if any,\nprior to execution; and\n2. Approve Strategic Solutions, LLC’s request to remove manufacturing from its current business license;\nand\n3. Adopt findings contained herein exempting the Second Amendment from further CEQA review under\nCEQA Section 15301, and direct staff to prepare and file the applicable Notices of Exemption for the\nproject recommended for approval; and\n4. Take such additional, related action that may be desirable, and/or provide the City Attorney’s office and/or\nstaff with additional or alternative directive(s).

Award Professional Services Agreement No. 4244 to Transtech Engineers, Inc. for Building Plan Check,\nBuilding Inspection, and Planning Consulting Services based on proposals received and evaluation\nratings conducted pursuant to Request for Proposal (RFP) No. 25-05; and\n2. Authorize the City Manager to execute all required documents related to the Professional Services\nAgreement between the City of Montebello and Transtech Engineers, Inc. in a form approved by the City\nAttorney’s office; and\n3. Award Agreement No.4230 to KYA Services, LLC (KYA Services) for the Restroom Renovation Services\nRequest for Proposal No. 24-24 (RFP No. 24-24), for a total not-to-exceed amount of One Million, Four\nHundred Ninety-Nine Thousand, One Hundred Eighty-Two Dollars ($1,499,182); and\n2. Authorize the City Manager and/or his designee to approve change orders up to five percent (5%) or\n$74,960, of the total agreement amount; and\n3. Approve issuing an annual blanket purchase order to L.N. Curtis and Sons for equipment and fire-related\nsupplies for apparatus for daily emergency operations in an initial amount to not exceed $100,000\nannually beginning Fiscal Year 2024-25 through 2025-26; and\n2.
