ADOPTION OF THE FISCAL YEAR 2024/25 OPERATING AND CAPITAL BUDGET\nFOR THE CITY OF STANTON AND STANTON HOUSING AUTHORITY; APPROVE\nEMPLOYEE BENEFITS AND SALARY RATES FOR FISCAL YEAR 2024/25; ADOPT\nTHE FISCAL YEAR 2024/25 APPROPRIATIONS LIMIT; ADOPT FISCAL YEAR\n2024/25 RESERVE POLICY; APPROVE THE CITY INVESTMENT POLICY FOR\nFISCAL YEAR 2024/25; WAIVE COMPETITIVE BIDDING REQUIREMENTS FOR\nCERTAIN COMMODITY PURCHASES; APPROVE FIRST AMENDMENT TO THE LAW\nENFORCEMENT SERVICES AGREEMENT FOR FISCAL YEAR 2024/25 (COUNTY OF\nORANGE); AND APPROVE INTERFUND TRANSFERS FOR FISCAL YEAR 2023/24\nJune 11, 2024\nDuring its regular City Council meeting held on May 14, 2024, the City Council reviewed\nthe Proposed Operating and Capital Budget for Fiscal Year 2024/25. During the meeting,\nthe City Council approved a number of decision packages that resulted in total\nappropriations increasing by approximately $4.2 million. As a result, total Fiscal Year\n2024/25 proposed appropriations (for all City Funds) increased from $45.9 million (as of\nMay 14, 2024) to $50.1 million. The Proposed Budget for Fiscal Year 2024/25 is provided\nas Attachment A.\nIn addition to adopting the Fiscal Year 2024/25 Operating and Capital Budget, staff is\nrecommending City Council approval of the following:\n• Annual approval of employee benefits and salary rates (Attachment D);\n• Approval of amended position classification manual (Attachment E);\n• Approval of amended personnel rules (Attachment F);\n• Annual approval of the City’s appropriation limit (Attachment G);\n• Annual approval of the City’s Reserve Policy (Attachment H);\n• Annual approval of the City’s Investment Policy (Attachment J);\n• Annual approval waiving competitive bidding for certain commodity purchases;\nand,\n• Approval of the first amendment to the agreement with the County of Orange for\nlaw enforcement services (Attachment K).\nLastly, staff is requesting City Council approval to transfer $1.8 million in developer\nagreement fees (for public benefit fees, beautification/enhancement fees, and\nneighborhood preservation fees) collected in the General Fund to new special revenue\nfunds established for each fee to facilitate the tracking of the receipt and spending of\nthese fees (Attachment M).\nRECOMMENDED ACTION:\n1. City Council find that these items are not subject to the California Environmental\nQuality Act (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or\nadministrative activities of governments that will not result in direct or indirect physical\nchanges in the environment); and\n2. Adopt Resolution No. 2024-20 adopting the City’s Fiscal Year 2024/25 Operating and\nCapital Budget, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, ADOPTING THE FISCAL YEAR 2024/25 OPERATING\nAND CAPITAL BUDGET AND AUTHORIZING EXPENDITURES AND\nAPPROPRIATIONS RELATED THERETO”; and\n3. Adopt Resolution No. SHA 2024-01 adopting the Stanton Housing Authority’s Fiscal\nYear 2024/25 Operating and Capital Budget, entitled:\nJune 11, 2024\n“A RESOLUTION OF THE STANTON HOUSING AUTHORITY OF THE\nCITY OF STANTON, CALIFORNIA, ADOPTING THE FISCAL YEAR\n2024/25 OPERATING AND CAPITAL BUDGET AND AUTHORIZING\nEXPENDITURES AND APPROPRIATIONS RELATED THERETO”; and\n4. Adopt Resolution No. 2024-16 approving the employee benefits and salary rates,\nentitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, REGARDING EMPLOYEE BENEFITS AND SALARY\nRATES FOR ALL CLASSES OF EMPLOYMENT”; and\n5. Adopt Resolution No. 2024-17, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, AMENDING THE POSITION CLASSIFICATION\nMANUAL”; and\n6. Adopt Resolution No. 2024-18, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, AMENDING AND ADOPTING PERSONNEL RULES FOR\nTHE ADMINISTRATION OF THE CITY’S PERSONNEL SYSTEM AND\nREPEALING ALL OTHER RESOLUTIONS AND MOTIONS\nINCONSISTENT HEREWITH”; and\n7. Adopt Resolution No. 2024-21 approving the appropriations limit for Fiscal Year\n2024/25, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA ADOPTING ITS ARTICLE XIIIB APPROPRIATION\nLIMITATION (GANN LIMITATION) FOR FISCAL YEAR 2024/25”; and\n8. Adopt Resolution No. 2024-22 approving the City’s Reserve Policy, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, APPROVING THE CITY OF STANTON RESERVE POLICY\nFOR FISCAL YEAR 2024/25”; and\n9. Approve the City’s Investment Policy for Fiscal Year 2024/25; and\n10. Waive the competitive bidding requirements for certain commodity purchases (e.g.,\nasphalt, sand, and paint) during Fiscal Year 2024/25; and\n11. Authorize the City Manager to execute the First Amendment to the Five-Year\nAgreement with the County of Orange for the provision of law enforcement services;\nand\nJune 11, 2024\n12. Authorize staff to transfer $1,507,796 from the General Fund (#101) to the Public\nBenefit Fees Fund (#104) in Fiscal Year 2023/24; and\n13. Authorize staff to transfer $190,000 from the General Fund (#101) to the Beautification\nFees Fund (#105) in Fiscal Year 2023/24; and\n14. Authorize staff to transfer $108,000 from the General Fund (#101) to the\nNeighborhood Preservation Fees Fund (#106) in Fiscal Year 2023/24.

APPLICATION FOR FUNDS FOR THE ENVIRONMENTAL CLEANUP, TIER 1 GRANT\nPROGRAM AND APPROPRIATION OF FUNDS\nThe Orange County Transportation Authority (OCTA) has issued a call for projects for the\nEnvironmental Cleanup Program (ECP), Tier 1 Grant. The City is requesting\napproximately $20,240 in funds from OCTA to purchase and replace the grate at the\nstorm channel on Western Avenue at 10660 Western Avenue to keep trash from reaching\nlocal waterways and mitigate flooding on Western Avenue. If the grant is awarded, the\nCity is required to provide a 20% match of $5,060, for a total project cost of $25,300. Staff\nis recommending the City Council authorize staff to appropriate $5,060 from the City’s\nCapital Projects Fund (#305) if the grant is awarded.\nRECOMMENDED ACTION:\n1. City Council declare that the project is categorically exempt from the California\nEnvironmental Quality Act (“CEQA”) under Section 15301(c) – Existing highways and\nstreets, sidewalks, gutters, bicycle, and pedestrian trails, and similar facilities; and\n2. Adopt Resolution No. 2024-23 authorizing the application of funds for the\nEnvironmental Cleanup, Tier 1 Grant Program, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON\nAUTHORIZING AN APPLICATION FOR FUNDS FOR THE\nENVIRONMENTAL CLEANUP, TIER 1 GRANT PROGRAM UNDER\nORANGE COUNTY LOCAL TRANSPORTATION ORDINANCE NO. 3\nFOR THE ENVIRONMENTAL CLEANUP PROGRAM PROJECT”; and\n3. Authorize the Public Works Director to sign the 2024 Tier 1 Call for Projects\nApplication for Funding; and\n4. Authorize staff to appropriate $5,060 from the available fund balance in the Capital\nProjects Fund (#305) to fund the required 20% matching requirement if the grant is\nawarded.

FOR CITYWIDE LANDSCAPING MAINTENANCE\nSERVICES\nAs the current contract is set to expire on June 30, 2024, City staff released a “Request\nfor Proposal” (RFP) soliciting proposals to provide landscape maintenance services\ncitywide. Staff recommends awarding a three-year contract to West Coast Arborist, Inc.\nin an amount not-to-exceed $1,245,000 or $415,000 annually.\nRECOMMENDED ACTION:\nJune 11, 2024\n1. City Council declare this project to be categorically exempt under the California\nEnvironmental Quality Act (CEQA), Class 1, Section 15301(h) as maintenance of\nexisting landscaping; and\n2. Award a professional services agreement to BrightView Landscape Services, Inc. to\nprovide landscape maintenance services for three-years in an amount not-to-exceed\n$1,245,000 or $415,000 annually; and\n3. Authorize the City Manager to bind the City of Stanton and BrightView Landscape\nServices, Inc. in a contract to provide the services.

AWARD OF CONSTRUCTION CONTRACT FOR THE FAMILY RESOURCE CENTER\nRENOVATION (PHASE II) PROJECT (TASK CODE NO. 2023-201) AND TRANSFER\nOF FUNDS\nTwo bids for the Family Resource Center Renovation (Phase II) Project were opened on\nMay 9, 2024. Based on the post-bid analysis of the bids received, staff has determined\nthe bid submitted by A2Z Construct, Inc. to be the lowest responsible and responsive bid\nat $238,000. The total funds needed to complete this project ($282,000) are more than\nthe available funds ($248,170). Staff is requesting City Council approval to transfer\nsavings from the completed Family Resource Center Improvements (Phase 1) Project\n(Task Code No. 2022-201) to fund the shortfall of $33,830.\nRECOMMENDED ACTION:\nJune 11, 2024\n1. City Council find that this project is exempt from the California Environmental Quality\nAct (“CEQA”), Class 2, Section 15302 as replacement of existing structures and\nfacilities; and\n2. Award a construction contract for the Family Resource Center Renovation (Phase II)\nProject to A2Z Construct, Inc. for the bid amount of $238,000 and reject all other bids;\nand\n3. Authorize the City Manager to bind the City of Stanton and A2Z Construct, Inc. in a\ncontract for the construction; and\n4. Authorize the City Manager to approve contract changes, not to exceed 10-percent of\nthe bid amount ($23,800); and\n5. Approve the transfer of $33,830 from the Family Resource Center Improvements\n(Phase 1) Project (Task Code No. 2022-201) to increase the Family Resource Center\nRenovation (Phase II) Project (Task Code No. 2023-201) Fiscal Year 2023/2024\nbudget from $363,059 to $396,889.

ADMINISTRATIVE POLICY FOR UNCLAIMED PROPERTY\nDuring the last two fiscal year audits, the City’s auditors, Gruber and Lopez, Inc., have\nverbally recommended the City document a written policy to address the handling of\nunclaimed property. The California Government Code requires the City to adopt a formal\npolicy regarding the handling of unclaimed property to exercise the process outlined in\nCalifornia Government Code Sections 50050-50056. Attachment A includes an\nadministrative policy titled “Unclaimed Property Policy” to establish a procedure to\nescheat these funds.\nJune 11, 2024\nRECOMMENDED ACTION:\n1. City Council find that these actions are not subject to California Environmental Quality\nAct (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment) and even if they were considered a project, they would still be\nexempt from CEQA under State CEQA Guidelines Section 15301; and\n2. 9M. SELECTION OF FIREWORKS LICENSEES FOR 2024\nCity Council may select licensees for 2024 fireworks sales.\nRECOMMENDED ACTION:\n1. City Council find that the action is exempt from the California Environmental Quality\nAct (“CEQA”) under Section 15061(b)(3) of the State CEQA Guidelines as the activity\nis covered by the general rule that CEQA applies only to projects which have the\npotential for causing significant effect on the environment. Where is can be seen with\ncertainty that there is no possibility that the activity in question may have a significant\neffect on the environment, the activity is not subject to CEQA; and\n2.
