Claim Rejection It is recommended that the City Council reject the\nfollowing claim and direct staff to send the appropriate notice of rejection\nto claimant:\n· Douglas Salazar The claimant alleges property\ndamage.\n· Intact Insurance aso FedEx The claimant alleges property\ndamage.\n· Kin Yip Lui The claimant alleges property\ndamage.\nThis government claim, and all government claims, should be considered\nas potential lawsuits in the future. Thus, it is requested that all City Staff,\nthe Mayor and all Council Members refrain from making any statements,\nwhether public or private in nature. It is important that no statements be\nmade so as to not prejudice this claim in any way which can happen if\npublic or private comments are made about this claim by City staff or\nCouncil Members.\nPUBLIC HEARING

A request for consideration of a Zoning Text Amendment to repeal and\nreplace Subchapter 153.170 pertaining to Sign Regulations in the City of\nBaldwin Park to include new language regarding new static or digital\nbillboard construction and billboard relocation agreements, incorporation\nof previously approved sign regulations that were not codified, and\nreorganization of the chapter as a whole. (Location: Citywide; Applicant:\nCity of Baldwin Park; Case Number: AZC 24-02).\nIt is recommended that the City Council\n1. Conduct a public hearing.\n2. Find the proposed ordinance is exempt from environmental review\nunder the California Environmental Quality Act (Pub. Resources\nCode, §§ 21000 et seq.) (âCEQAâ) and the State CEQA Guidelines\n(Cal. Code Regs, tit. 14, §§ 15000 et seq.). Specifically, the\nordinance is categorically exempt from CEQA under Guidelines\nSection 15061(b)(3) (Common Sense Exception) since the\nordinance is not a âprojectâ and can be seen with certainty that there\nis no possibility that the ordinance may have a significant effect on\nthe environment, either directly or indirectly, and that therefore no\nenvironmental review under CEQA is required.\n3. Introduce for first reading, by title only and waive further reading,\nOrdinance 1510, entitled, âAN ORDINANCE OF CITY COUNCIL OF\nTHE CITY OF BALDWIN PARK REPEALING AND REPLACING\nSECTION 153.170 OF THE MUNICIPAL CODE RELATING TO\nSIGN REGULATIONS TO INCLUDE NEW LANGUAGE\nREGARDING NEW STATIC OR DIGITAL BILLBOARD\nCONSTRUCTION AND BILLBOARD RELOCATION\nAGREEMENTS, INCORPORATION OF PREVIOUSLY APPROVED\nSIGN REGULATIONS THAT WERE NOT CODIFIED, AND\nREORGANIZATION OF THE CHAPTER AS A WHOLE

12. Public Hearing Regarding Fiscal Year 2024-25 Annual Action Plan. Staff\nrecommends that the Mayor and City Council approve the Final 2024-25\nAnnual Action Plan and authorize the City Manager to execute the\ndocuments required for submission of this Plan for CDBG and HOME\nFunds to the United States Department of Housing and Urban\nDevelopment. Staff also recommends that the Mayor and City Council\nauthorize staff to make changes to funding allocations as described in this\nstaff report once the final 2024 entitlement grants are announced by HUD.

13. Appeal of the Planning Commission's March 27, 2024, adoption of a\ntentative parcel map (TPM 084199).\nIt is recommended that the City Council\n1. Conduct a public hearing.\n2. Find that pursuant to Public Resources Code section 21166 and\nState CEQA Guidelines section 15162, the Project was analyzed by\nthe 2016 TOD Downtown Specific Plan EIR (Exhibit C) and\nAddendum to the 2016 TOD Downtown Specific Plan EIR (Exhibit\nD), as well as the Transportation Assessment (Exhibit E) that was\nprepared for this Project and that no further environmental review is\nnecessary.\n3. City Council action to:\na. 14. Renewal of the City's services contract with Los Angeles County\nDepartment of Animal Care and Control (DACC).\nIt is recommended that the City Council\n1. Approve the contract renewal and authorize the Mayor, City Clerk\nand City Attorney to execute the agreement.\n2. Authorize the Director of Finance to appropriate $911,754 among\nthe General Fund (#100) Gas Tax Fund (#240 and ARPA Fund\n(#275) and include in the FY 2024-25 budget.\n3. Authorize the Chief Executive Officer to inform DACC of the Cityâs\nintention to renew the contract.

5. Request for Authorization to Purchase a Laser 3D Scanner.\nIt is recommended that the City Council\n1. Authorize the Police Department to purchase the requested FARO\n3D laser scanner and accessories; and\n2. Authorize the Director of Finance to appropriate $63,743.26. from\nthe Police Special Funds- Traffic Safety Fund #271; and\n3. Authorize the Chief of Police or his designee to complete all\nappropriate documentation for the purchase.

Approval of a bench of pre-qualified Environmental Planning Consultants\nto prepare environmental documents for development projects.\nStaff recommends that the City Council take the following actions:\n1. Approve the list of consultants to be used for Environmental\nConsulting Services for three years ending May 15, 2027, that\nincludes Placeworks, ECORP, UES, MIG, Dudek, De Novo Planning\nGroup, SWCA, First Carbon Solutions, Rincon, and Eco Tierra; and\n2. Approve and authorize the Chief Executive Officer or his designee\nand City Attorney to execute Agreements in substantial form to that\nattached as Attachments 1-2, subject to any non-substantive\nchanges made by the CEO and City Attorney.

Consider Approval of Amendment No. 1 to the Maintenance Services\nAgreement (MSA) With West Coast Arborists (WCA) Inc., for Citywide\nTree Maintenance Services and Authorize Staff to Publish a Request for\nProposals for Tree Maintenance Services\nStaff recommends that Council:\n1. Approve Amendment No. 1 to the Maintenance Services Contract\nwith West Coast Arborists (WCA), Inc. for Citywide Tree\nMaintenance Services, extending the term contract for an additional\none (1) year and adjusting rates by 3.4% for FY24-25 due to CPI\nincrease; and,\n2. Approve an increase to the annual not-to-exceed contract amount\nfrom $165,000 to $171,000 in FY24-25 due to the CPI increase;\nand,\n3. Authorize Staff to publish a Request for Proposals for Tree-trimming\nservices prior to the expiration of Amendment No. 1; and,\n4. Authorize the Mayor and City Clerk to execute Amendment No. 1;\nand,\n5. Authorize the Finance Director to make necessary budget\nadjustments per the increase of rates to allow payments approved\nFY 2023-24 and any subsequent fiscal years within contract\namendment terms.

8. Award of Contract to E.T.E. Fitness Equipment for the Officer Wellness\nand Mental Health Project to Upgrade the Police Gym Facility\nIt is recommended that the City Council\n1. Approve the contract with E.T.E. Fitness Equipment in the amount of\n$34,977.53 for the purchase and installation of gym equipment; and\n2. Authorize the Mayor and City Attorney to execute the agreement.

Approve a Professional Services Agreement (PSA) with CWE for\nConstruction Management and Inspection Services for City Project No.\nCIP 21-198 Barnes Park Multi-Benefit Stormwater Capture Project It is\nStaff's recommendation that the City Council:\n1. Approve the Professional Services Agreement with CWE in the\namount of $964,697.00; and\n2. Authorize the Mayor and City Clerk to execute the contract with\nCWE for construction management and inspection services of the\nCity of Baldwin Parkâs Barnes Park Project.
