(1) 21-1155 CD 14 HEARING OF PROTESTS AND ORDINANCE FIRST CONSIDERATION relative to levying the Little Tokyo Business Improvement District (District) special assessment for the District’s 20th Fiscal Year (operating year) beginning on January 1, 2023 through December 31, 2023. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: HEAR PROTESTS against the proposed levying of the special assessment for the District’s 2023 Fiscal Year, pursuant to Section 36524 of the California Streets and Highways Code. PRESENT and ADOPT accompanying ORDINANCE, dated February 14, 2023, levying the special assessment for the District’s 2023 Fiscal Year, if a majority protest, as defined by Section 36525 of the California Streets and Highways Code is found not to exist. APPROVE the Little Tokyo Business Improvement District Advisory Board for the District’s 2023 Fiscal Year. AUTHORIZE the City Clerk, subject to City Attorney approval, to prepare, execute and administer a contract between the City and the Little Tokyo Business Improvement District Corporation, the nonprofit service provider for administration of the District. Fiscal Impact Statement: The City Clerk reports that there are no assessments to be paid for City-owned properties located within the boundaries of the District. Therefore, there is no impact on the General Fund.

(10) 21-1458 HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to improving evaluation processes, contract procedures and timely payments between the City and the Los Angeles Homeless Services Authority (LAHSA); and related matters. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: REQUEST the Controller to consolidate the accounts within each funding source to fit into the program categories contained in Recommendation A of the Los Angeles Housing Department (LAHD) report dated February 28, 2023, attached to Council file No. 21-1458, beginning Fiscal Year 2022-23. The request should identify existing accounts or establish new appropriation accounts in the City’s Financial Management System that can span different funding sources. DIRECT the LAHD to include contract provisions in all contracts that require cost allocation plans for sub recipients in order to finalize any contract agreement with the LAHSA. APPROVE the Timeline (Attachment A of the LAHD report dated February 28, 2023) for LAHD-LAHSA-Sub recipient contracting so as to create a consistent and realistic expectation for when agreements may be executed, sub recipients may expect to receive payment, and when services may start to be procured. DIRECT the City Administrative Officer (CAO) and the LAHD to: Align data reporting requirements for the CAO with the Scopes of Work outlined in each LAHD/LAHSA contract for all funding sources. The requirements of the Scopes of Work in any of the contracts would be required to match any applicable metrics required by the CAO. Design a single quarterly reporting structure that encapsulates data from all programs under all funding sources to be made available, equally to the LAHD and CAO, and further, to Council upon request. DIRECT the LAHD to work in coordination with the CAO, Chief Legislative Analyst (CLA), and LAHSA to align reporting requirements and measurable goals stated in all LAHSA contracts with an updated version of the Enhanced Comprehensive Homelessness Strategy to reflect the new landscape of homeless services in the City. INSTRUCT the CAO to analyze the existing ordinance to provide greater flexibility within the contracts process to enable grantees to receive payment more rapidly, and report on the administrative cap status for each funding source related to homelessness. DIRECT the LAHD to include the billing cycle provision contained in Recommendation G of the LAHD report dated February 28, 2023, to all future LAHSA contracts. INSTRUCT the LAHD to include a grievance-like procedure in all of its contracts with the LAHSA which would allow for clearer communication between all three parties. INSTRUCT the CAO, in partnership with the LAHD, to review the administrative cap rate for all General Funded LAHSA contracts and report with recommendations in the best interest of City tax payers.

(12) 22-0600-S101 BUDGET, FINANCE AND INNOVATION COMMITTEE REPORT relative to the Third (Mid-Year) Financial Status Report (FSR) for Fiscal Year (FY) 2022-23. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: APPROVE the recommendations of the City Administrative Officer (CAO) as detailed in the Third FSR for FY 2022-23, dated March 10, 2023, attached to the Council file. AMEND the Ninth transaction relative to Accumulated Overtime for the Police Department, on page five of Attachment 4 included in the CAO report, attached to the Council file, to update the source account to reflect a transfer of $1.2 million within Police Department Fund No. 100/70, from Salaries As-Needed Account No. 001070, to Accumulated Overtime Account No. 001095. AUTHORIZE the Controller to make technical corrections to Schedule 3, Forfeited Assets Trust Fund of the Police Department, as follows: Transfer appropriations only in the amount of $15,052 from the Police Account in the U.S. Treasury Asset Forfeiture Fund to the California State Asset Forfeiture Fund, and transfer appropriations only in the amount of $109,635 from the Supplemental Police Account in the U.S. Treasury Asset Forfeiture Fund to the U.S. Department of Justice Asset Forfeiture Fund ($102,791) and the California State Asset Forfeiture Fund ($6,844). TRANSFER and APPROPRIATE $150,000 from the General City Purposes Fund No. 100/56, Account No. 000867 (Council District 10 Council Fee Subsidy) to the General City Purposes Fund No. 100/56, Account No. 000710 (Council District 10 Community Services). Fiscal Impact Statement: The CAO reports that a total of $129.12 million in projected over-expenditures are identified in the Mid-Year (Third) FSR. Transfers, appropriations, and other budgetary adjustments totaling approximately $185.92 million are recommended in Sections 1, 2, and 5 of the CAO report. This includes $31.48 million in transfers from the Unappropriated Balance Reserve for Mid-Year Adjustments Account, and $25.55 million in transfers from the Reserve Fund. Financial Policies Statement: The CAO reports that the recommendations in the report comply with the City’s Financial Policies as the recommended transactions use current revenues and balances to pay for current operations. Debt Impact Statement: The CAO reports that there is no debt impact to the General Fund as a result of the recommendations in the report as there are no new debt issuance authorizations recommended.

(26) 21-1428-S1 CD 4 MOTION (RAMAN - YAROSLAVSKY) relative to funding for the continuation of consulting services provided by Daeco Management, LLC to assist with planning for the eventual construction of affordable and permanent supportive housing in Council District 4. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: TRANSFER and APPROPRIATE $85,000 in the Council District 4 portion of the "Neighborhood Service Enhancements" line item in the General City Purposes Fund No. 100/56 to the Affordable Housing Trust Fund No. 44G/43, Account No. 43VB56 (Affordable Housing Land Review), for an extension of services provided by Daeco Management, LLC to assist in identifying locations and planning for the eventual construction of affordable and permanent supportive housing in Council District 4 to help reduce homelessness. AUTHORIZE the Los Angeles Housing Department (LAHD) to prepare, process, and execute the necessary documents with Daeco Management, LLC, or any other agency or organization, as appropriate, in the above amount, for the above purpose, for an additional period of 8 months, subject to the approval of the City Attorney as to form. FIND that the services provided by Daeco Management LLC are of an expert and technical nature and are temporary and occasional in character and therefore competitive bidding is not practicable or advantageous and the work can be performed more economically or feasibly by an independent contractor than by City employees. (4) 22-1313 HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to a citywide rehousing strategy for people experiencing recreational vehicle (RV) homelessness; and related matters. Recommendations for Council action: APPROVE the City Administrative Officer’s (CAO) proposed citywide rehousing strategy for people experiencing RV homelessness, as outlined in the CAO report dated February 10, 2023, attached to the file. DIRECT the CAO to report to Council on a quarterly basis with performance and outcome data related to the implementation of the citywide rehousing strategy for people experiencing RV homelessness, including, but not limited to data and metrics on the number and location of RVs being used as dwellings, the number of persons experiencing RV homelessness, potential California Vehicle Code and Los Angeles Municipal Code violations, outreach contacts, service referrals, housing or other placements, refusals and more. INSTRUCT the Directors and General Managers, Bureau of Sanitation (BOS), the Los Angeles Police Department (LAPD), the Los Angeles Department of Transportation (LADOT), Bureau of Street Services, other relevant City departments; and, REQUEST the Los Angeles Homeless Services Authority (LAHSA) to coordinate all RV outreach and rehousing operations through the CAO’s citywide outreach team. REQUEST the LAHSA, working with the CAO, to: Report to Council in 30 days with detailed utilization data for the City’s current safe parking sites, including utilization rates in program years prior to the onset of the COVID-19 pandemic in March 2020. Report to Council in 45 days with a plan to establish 24-hour safe parking locations for RVs that will include on-site case management, housing navigation services, vehicle maintenance services, such as pumping septic tanks, and hygiene services, and with recommendations for changes to the Safe Parking program requirements to lower barriers of entry for people experiencing RV homelessness. REQUEST the City Attorney, working with the CAO, LAPD, LADOT, and other departments as necessary, to draft a waiver form for an individual to voluntarily relinquish their vehicle to the City. INSTRUCT the BOS to report on the feasibility, cost and funding necessary to launch a citywide mobile RV waste disposal program, including a consideration of expanding Council District 2’s ServeLA program. INSTRUCT the CAO to: Release a Request for Information for privately-held properties, including parking lots or other large vacant spaces that can be used for short-term RV storage. Include, in its prioritization of RVs to be served through the Citywide strategy, factors including RVs with larger numbers of people living in them, families with minor children, the condition of the RVs, and the condition and characteristics of the surrounding area such as fire sensitivity. INSTRUCT the CAO, with the assistance of the Chief Legislative Analyst (CLA), to: Work with the Mayor’s Office and Council offices, LAHSA, and nonprofit service providers, to prioritize encampments that include people experiencing RV homelessness for the Inside Safe Initiative. Prioritize programs within the Citywide Rehousing Strategy for People Experiencing RV Homelessness to correspond with available funding. Report to Council on the City’s Encampment Resolution Fund application prior to submission and solicit input from Council on locations to include.

(5) 22-1324 CD 7 HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to the implementation and analysis of the pilot recreational vehicle (RV)-to-Home program in Council District 7; and related matters. Recommendations for Council action: INSTRUCT the City Administrative Officer (CAO) to report to Council in 60 days with recommendations for implementing the adopted citywide rehousing strategy for people experiencing RV homelessness in targeted locations across the City based on several factors, such as 2022 Point-in-Time Count RV data, or 2023 Point-in-Time Count RV data if available, needs of the people experiencing RV homelessness, the environmental, health, and safety conditions of the RVs, surrounding roads and other spaces, and public rights of way, concerns from constituents, and Council priorities, and including an updated cost analysis and implementation plan. REQUEST the City Attorney to conduct an analysis of the adopted citywide rehousing strategy for people experiencing RV homelessness, as outlined in the CAO report dated February 10, 2023, attached to Council file No. 22-1313 and as further understood here, including an assessment of contracting and procurement options available under the declaration of a local homelessness emergency and subsequent action by Council to provide additional relief under the emergency order. INSTRUCT the Department of City Planning to conduct an analysis of the zoning considerations of implementing RV temporary storage citywide. DIRECT the Los Angeles Police Department and the Los Angeles Department of Transportation to report to Council within 45 days on the feasibility of aligning their internal departmental policies with existing law and clarifying what type of vehicle (or factors relating to said vehicle) are to be considered in determining when a vehicle is in fact abandoned thus making it subject to towing and disposal. REQUEST the Los Angeles Homeless Services Authority to report to Council within 45 days with a detailed analysis of RVs being used as dwellings for people experiencing homelessness according to the 2022 and 2023 Point-in-Time Counts, including using and sharing with the City geospatial data to conduct spatial analyses, pattern and hot-spot analyses, and mapping of RVs across the City. Fiscal Impact Statement: The CAO reports that approval of the recommendations in this report will not have an immediate impact on the General Fund as funding recommendations will be provided in a future report. (6) 18-0610-S3 HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to the establishment of a Right to Counsel Ordinance and program; and related matters. Recommendations for Council action, as initiated by Motion (Raman – et al. – Harris-Dawson): INSTRUCT the Los Angeles Housing Department (LAHD), with assistance from the City Attorney and any other City departments, as needed, to report within 60 days with recommendations for the establishment of a Right to Counsel ordinance and program, subject to the availability of funds, for tenants facing eviction in the City. The recommendations should build upon the Los Angeles Housing + Community Investment Department’s November 1, 2019 report regarding recommendations for a City of Los Angeles Eviction Defense Program, in addition to lessons learned from the establishment and implementation of the COVID-19 Response Eviction Defense Program, and should utilize the National Coalition for a Civil Right to Counsel's Model Legislation as a model for best practices for the development of a City ordinance. Specifically, the recommendations should consider including the following: Coverage for tenants at 80 percent of the Area Median Income or below who live in the City. Full legal representation for any judicial or administrative proceedings to evict or terminate the tenancy or housing subsidy of a covered individual, including first appeals at the discretion of contracted legal service providers. A requirement that landlords provide notice to tenants of the right to counsel when tenancies are initiated and attached to any termination notice in the primary language of the tenant. A requirement that the LAHD work with designated community groups to engage and educate tenants about their rights and provide tenants with navigation services. An annual reporting requirement on the number of individuals served, case outcomes, and engagement and education efforts. An implementation time line of no more than five years, prioritizing vulnerable individuals based on zip codes and/or criteria developed by the LAHD in collaboration with contracted legal service providers and community based organizations. As in the Right to Counsel ordinances in other jurisdictions, a provision clarifying that the Right to Counsel program be established and operated "subject to appropriation" of the necessary funds. INSTRUCT the LAHD, with assistance from the City Administrative Officer (CAO), Chief Legislative Analyst (CLA), the City Attorney and any other City departments, as needed, to report within 60 days with a detailed cost breakdown for the Right to Counsel ordinance and program and staffing needs, in addition to a prospective year-by-year spending plan for the implementation of the program subject to funding becoming available. DIRECT the LAHD to engage housing providers when developing recommendations to establish the Right to Counsel ordinance and program.

Recommendation for Council action, pursuant to Motion (Park – Price): REQUEST the HACLA to report on the cyberattack that targeted its systems in December 2022, including the extent of the data breach, whether personal information of any of the 19,000 families that live in the HACLA properties and Section 8 applicants and holders was compromised, as well as the steps that HACLA is taking to secure its systems moving forward. (8) 17-0090-S19 HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to increasing the Area Median Income (AMI) limits in Proposition HHH (Prop HHH) funded projects serving veterans. Recommendation for Council action: AUTHORIZE the General Manager, Los Angeles Housing Department (LAHD), or designee, to: Increase the AMI limits in Prop HHH funded veteran projects to 50 percent AMI, as needed and determined by the LAHD. Modify the terms of loan documents and execute all necessary documents to reflect such modifications, subject to the approval of the City Attorney as to form. The impact of Senate Bill 4 (SB 4), if enacted into law, would have on further streamlining the development of affordable housing at these locations. INSTRUCT the LAHD, the DCP, and the CAO, to request input from affordable housing developers, the co-sponsors of SB 4, and religious institutions that have developed or are in the process of developing on-site affordable housing, to include recommendations in their report for creating affordable and supportive housing on property owned by faith-based institutions.
