Senate Bill 707 Brown Act Implementation: Consideration of (1)\na Legislative Body Reasonable Accommodation Policy for\nRemote Participation at Meetings; (2) a Reasonable\nAccommodation Policy for Public Participation at Brown Act\nMeetings; and (3) an Internet Service and Telephonic Service\nDisruption Policy for All City Council, Commission, Committee,\nand Board Meetings - That the City Council adopt Resolution 7791\nto adopt the following policies to implement provisions of the Brown\nAct, as recently amended by Senate Bill 707 (SB 707): 1) a\nLegislative Body Reasonable Accommodation Policy for Remote\nParticipation at Meetings; and, 2) a Reasonable Accommodation\nPolicy for Public Participation at Brown Act Meetings; and, 3) an\nInternet Service and Telephonic Service Disruption Policy for City\nCouncil, Commission, Committee, and Board Meetings.\nCONSENT CALENDAR\nItems on the consent calendar are considered to be routine and are enacted by a\nsingle motion with the exception of items removed by Council Members.

F. Approving Submittal of FY 2026-27 Measure M2 Eligibility\nPackage and its Components - That the City Council: 1. Adopt\nResolution 7792 Concerning the Status and Update of the Local\nAdopt the seven-year Measure M2 Capital Improvement Program\n(CIP) for Fiscal Years 2026-2027 through 2032-2033; and, 3. Direct\nthe City Manager, or their designee, to file the adopted Resolution,\nCapital Improvement Program and the Measure M2 eligibility\ndocuments with Orange County Transportation Authority (OCTA) in\ncompliance with the requirements of OCTA.

Approving and Authorizing Professional Services Agreement\nwith Siemens Industry, Inc. for HVAC Maintenance and Repair\nServices - That the City Council adopt Resolution 7793: 1.\nAuthorizing the City Manager to execute a Professional Services\nAgreement with Siemens Industry, Inc. to provide HVAC\nMaintenance and Repair Services for a three (3) year term in a not-\nto-exceed amount of $144,336; and, 2. Authorizing and directing the\nCity Manager to execute the Agreement; and, 3. Authorizing the City\nManager the option to extend the Agreement up to two (2) additional\none-year terms after its original term at an adjusted rate for each\noptional term calculated on the lesser of either (a) the most recent\ncooperative purchasing program renewal pricing under Sourcewell\nContract #080824-SIE in effect at time of election of the renewal\noption, or (b) six (6) percent of each term extension’s contract price;\nand, 4. Authorizing the City Manager, or designee, to approve repair\nservices and additional work requests in the amount of $40,000 per\nyear.

Awarding and Authorizing Execution of Maintenance Service\nAgreements for On-Call Utility and Electrical Maintenance,\nRepair and Emergency/Unexpected Task Services - That the City\nCouncil adopt Resolution 7794: 1. Approving and authorizing the\nCity Manager to execute an on-call maintenance service agreement\nwith T.E. Roberts, Inc., in the amount of $600,000 to provide On-Call\nUtility Maintenance, Repair and Emergency/Unexpected Task\nServices for a three (3) year term; and, 2. Approving and authorizing\nthe City Manager to execute an on-call maintenance service\nagreement with Valverde Construction, Inc., in the amount of\n$600,000 to provide On-Call Utility Maintenance, Repair and\nEmergency/Unexpected Task Services for a three (3) year term;\nand, 3. Approving and authorizing the City Manager to execute an\non-call maintenance service agreement with W.A. Rasic\nConstruction Company, Inc. in the amount of $600,000 to provide\nOn-Call Utility Maintenance, Repair and Emergency/Unexpected\nTask Services for a three (3) year term; and, 4. Approving and\nauthorizing the City Manager to execute an on-call maintenance\nservice agreement with Amtek Construction in the amount of\n$300,000 to provide On-Call Electrical Maintenance, Repair and\nEmergency/Unexpected Task Services for a three (3) year term;\nand, 5. Approving and authorizing the City Manager to execute an\non-call maintenance service agreement with Baker Electric in the\namount of $300,000 to provide On-Call Electrical Maintenance,\nRepair and Emergency/Unexpected Task Services for a three (3)\nyear term; and, 6. Approving and authorizing the City Manager the\noption to extend any or all such maintenance service agreements for\nUtility Maintenance, Repair and Emergency/Unexpected Task\nServices for up to two (2) additional one-year terms after its original\nterm, in a not-to exceed amount of $200,000 per one-year\nextension, and to execute any such extension; and, 7. Approving\nand authorizing the City Manager the option to extend any or all\nsuch maintenance service agreements for up to two (2) additional\none-year terms after its original term, in a not-to exceed amount of\n$100,000 per one-year extension, and to execute any such\nextension.

I. Approving and Authorizing the Purchase of an Industrial Power\nSweeper for Coastal and Street Grooming Operations - That the\nCity Council adopt Resolution 7795: 1. Approving and authorizing\nthe purchase for (1) Haacker Total Clean PowerBoss Armadillo 9X\nIndustrial Power Sweeper from Haacker Total Clean pursuant to the\nCooperative Purchase Contract with the Los Angeles Community\nCollege District Master Agreement Contract #40590, in accordance\nwith the cooperative purchasing procedures set forth in Seal Beach\nMunicipal Code Section 3.20.025(D), in the not-to-exceed amount of\n$66,726.23; and, 2. Approving and directing the City Manager to\napprove purchase orders and any necessary related documents for\nthe industrial power sweeper purchase; and, 3. Approving and\n\nauthorizing the City Manager to surplus existing equipment upon the\nreceipt of the new equipment purchases.

Awarding and Authorizing Execution of a Public Works\nAgreement with US Builders & Consultants, Inc. for the\nStormwater Treatment Improvements at Galleon Way and\nElectric Avenue, CIP SD2502 - That the City Council adopt\nResolution 7797: 1. Approving the scope of work, plans,\nspecifications and other contract documents for the Stormwater\nTreatment Improvements at Galleon Way and Electric Avenue, CIP\nSD2502 (Project); and, 2. Approving and awarding a Public Works\nAgreement to US Builders & Consultants, Inc. in the not-to-exceed\namount of $314,800 for the Project; and, 3. Authorizing the City\nManager to execute a Public Works Agreement with US Builders &\nConsultants, Inc.; and authorizing the City Manager to approve\nadditional work requests up to $78,700 (approximately 25%), in\nconnection with the Project; and, 4. Authorizing the City Manager, or\ndesignee, to approve construction support services in the amount of\n$55,000, in connection with the Project, to be performed by the\nCity’s on-call professional engineering firm BKF Engineers and on-\ncall inspection services contractor NV5, Inc.

Conducting a public hearing to receive\ninput and consider the proposed adjustment of the bidding threshold\nfor Public Works contracts to $42,982 pursuant to City Charter\nSection 1010, and adjusting the City Manager’s threshold to bind\nthe City with or without a written contract for the acquisition of\nequipment, supplies, labor, services or other items within the budget\napproved by City Council to $42,982 pursuant to City Charter 420\nand Resolution 6384; and, 2. Awarding and Authorizing Execution of a Public Works\nAgreement with Performance Pipeline Technologies, Inc. for\nthe Sewer Mainline Improvement Project (2026), CIP O-SS-2 - 1.\nApproving the plans, specifications, and contract documents for the\nSewer Mainline Improvement Project, CIP O-SS-2; and, 2.\nSustaining the bid protest of Performance Pipeline Technologies,\nInc. and rejecting the bid of the apparent low bidder, Estate Design\nand Construction, Inc., as non-responsive on the basis of the non-\nresponsive defects identified in the bid protest and by staff; and, 3.\nAwarding a Public Works Agreement to Performance Pipeline\nTechnologies, Inc. in the amount of $718,850.00, and rejecting all\nother bids; and, 4. Roberts, Inc. for the LCWA Watermain\nLining – Trenchless Technology Improvements, CIP WT2103 -\nThat the City Council adopt Resolution 7801: 1. Approving the\nplans, specifications, and contract documents for the LCWA\nWatermain Lining – Trenchless Technology Improvements, CIP\nWT2103; and, 2. Awarding a Public Works Agreement to T.E.\nRoberts, Inc. for the Project in the not-to-exceed amount of\n$3,209,485; finding bids submitted by Minako America Corporation\ndba Minco Construction and Vortex Services, LLC as non-\nresponsive; and rejecting all other bids; and, 3. Authorizing the City\nManager to execute the Public Works Agreement with T.E. Roberts,\nInc. for the Project; and authorizing the City Manager to approve\nadditional work requests up to $320,950 (approximately 10%), in\n\nconnection with the Project; and, 4. Authorizing the City Manager to\napprove construction support services in the amount of $234,976 in\nconnection with the Project, including engineering and\nenvironmental support, construction management, and inspection\nservices, to be performed by the City’s on-call professional services\ncontractors.
