PUBLIC HEARING RELATIVE TO PLACING THE ANNUAL LEVY OF\nASSESSMENTS FOR THE INSTALLATION, MAINTENANCE, AND SERVICING OF\nPUBLIC LIGHTING FACILITIES AND MEDIAN ISLANDS WITHIN THE BOUNDARIES\nOF THE TERRITORY INCLUDED IN STANTON LIGHTING AND LANDSCAPING\nDISTRICT NO. 1 FOR FISCAL YEAR 2023/24 PURSUANT TO THE LANDSCAPING\nAND LIGHTING ACT OF 1972\nOn May 9, 2023, the City Council adopted Resolution No. 2023-07, approving the\nEngineer’s Report, and Resolution No. 2023-08, declaring its intention to levy and\ncollect the annual assessments for installation, maintenance and servicing of Stanton\nLighting and Landscaping District No. 1 (“the District”) for Fiscal Year 2023/24 pursuant\nto the Landscaping and Lighting Act of 1972. Resolution No. 2023-08 also set the date\nof the public hearing for this matter for June 13, 2023. Harris & Associates, the City’s\nconsultant, prepared the District’s assessment roll for Fiscal Year 2023/24 (Exhibit A of\nAttachment A).\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or\nreasonably foreseeable indirect physical change in the environment) and\n15060(c)(3) (the activity is not a project as defined in Section 15378(b)(4) of the\nCEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it\nhas no potential for resulting in physical change to the environment, directly, or\nindirectly); and\n2. Conduct a public hearing concerning the extent of the District, the improvements, the\nproposed assessments, and all other matters pertaining hereto; and\n3. Adopt Resolution No. 2023-13, confirming the assessments for installation,\nmaintenance, and servicing of lighting and landscaping with the boundaries of the\nterritory included in the District and directing the Orange County Auditor-Controller\nplace the assessment on the property tax roll for Fiscal Year 2023/24, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, CONFIRMING THE ASSESSMENTS FOR INSTALLATION,\nMAINTENANCE, AND SERVICING OF LIGHTING AND LANDSCAPING\nWITHIN THE BOUNDARIES OF THE TERRITORY INCLUDED IN THE\nSTANTON LIGHTING AND LANDSCAPING DISTRICT NO. 1 FOR\nFISCAL YEAR 2023/24”.\nJune 13, 2023

PUBLIC HEARING RELATIVE TO PLACING THE ANNUAL SEWER SERVICE\nCHARGE FOR SEWER SERVICES ON THE PROPERTY TAX ROLL FOR FISCAL\nYEAR 2023/24\nOn August 8, 2017, the City held a noticed public hearing in compliance with\nProposition 218 and adopted the Annual Sewer Service Charges for Fiscal Years\n2017/18 through 2022/23 with Ordinance No. 1068. The approved rates include a 3.5%\nincrease annually for Fiscal Years 2018/19 through 2021/22. A new sewer service rate\nstudy is on hold pending the completion of the City’s Sewer Master Plan Update project.\nTherefore, staff is recommending no change to the Annual Sewer Service Charge\ncollected for Fiscal Year 2023/24. The purpose of this noticed public hearing is to\nconfirm the report prepared by the City’s consultant, Harris & Associates and to seek\nCity Council approval to request the Orange County Auditor-Controller place the Annual\nService Charge on the property tax roll for Fiscal Year 2023/24. The Sewer Service\nCharge Report (“Report”) prepared by the Consultant identifies each parcel subject to\nthe Annual Sewer Service Charge for Fiscal Year 2023/24 (Exhibit A of Attachment A).\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or\nreasonably foreseeable indirect physical change in the environment) and\n15060(c)(3) (the activity is not a project as defined in Section 15378(b)(4) of the\nCEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it\nhas no potential for resulting in physical change to the environment, directly, or\nindirectly); and\n2. Conduct a public hearing concerning the placement of the Annual Sewer Service\nCharge on the property tax roll for Fiscal Year 2023/24; and\n3. ADOPTION OF THE FISCAL YEAR 2023/24 OPERATING AND CAPITAL BUDGET\nFOR THE CITY OF STANTON AND STANTON HOUSING AUTHORITY; APPROVE\nEMPLOYEE BENEFITS AND SALARY RATES FOR FISCAL YEAR 2023/24; ADOPT\nTHE FISCAL YEAR 2023/24 APPROPRIATIONS LIMIT; ADOPT FISCAL YEAR\n2023/24 RESERVE POLICY; APPROVE THE CITY INVESTMENT POLICY FOR\nFISCAL YEAR 2023/24; WAIVE COMPETITIVE BIDDING REQUIREMENTS FOR\nCERTAIN COMMODITY PURCHASES; AND APPROVE A FIVE-YEAR AGREEMENT\nWITH THE COUNTY OF ORANGE FOR LAW ENFORCEMENT SERVICES\nOn May 16, 2023, the City Council held a budget workshop to review the Proposed\nOperating and Capital Budget for Fiscal Year 2023/24. During the budget workshop, the\nCity Council approved a number of decision packages that resulted in total\nappropriations increasing by approximately $5.1 million. In addition, since the budget\nworkshop, staff adjusted the proposed budget for the Sewer Maintenance Enterprise\nFund (#501) to provide sufficient funding for contracted sewer cleaning services per the\nresults of the City’s recently completed competitive bidding process. As a result, total\nFiscal Year 2023/24 proposed appropriations (for all City Funds) increased from $40.1\nmillion (at the budget workshop) to $45.4 million. The Proposed Budget for Fiscal Year\n2023/24 is provided as Attachment A.\nIn addition to adopting the Fiscal Year 2023/24 Operating and Capital Budget, staff is\nrecommending City Council approval of the following:\n• Annual approval of employee benefits and salary rates (Attachment D);\n• Annual approval of the City’s appropriation limit (Attachment E);\n• Annual approval of the City’s Reserve Policy (Attachment F);\n• Annual approval of the City’s Investment Policy (Attachment H);\n• Annual approval waiving competitive bidding for certain commodity purchases;\nand,\n• Approval of the five-year agreement with the County of Orange for law\nenforcement services (Attachment I).\nRECOMMENDED ACTION:\n1. City Council find that these items are not subject to the California Environmental\nQuality Act (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or\nadministrative activities of governments that will not result in direct or indirect\nphysical changes in the environment); and\n2. Adopt Resolution No. 2023-19 adopting the City’s Fiscal Year 2023/24 Operating\nand Capital Budget, entitled:\nJune 13, 2023\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, ADOPTING THE FISCAL YEAR 2023/24 OPERATING\nAND CAPITAL BUDGET AND AUTHORIZING EXPENDITURES AND\nAPPROPRIATIONS RELATED THERETO”; and\n3. Adopt Resolution No. SHA 2023-01 adopting the Stanton Housing Authority’s Fiscal\nYear 2023/24 Operating and Capital Budget, entitled:\n“A RESOLUTION OF THE STANTON HOUSING AUTHORITY OF THE\nCITY OF STANTON, CALIFORNIA, ADOPTING THE FISCAL YEAR\n2023/24 OPERATING AND CAPITAL BUDGET AND AUTHORIZING\nEXPENDITURES AND APPROPRIATIONS RELATED THERETO”; and\n4. Adopt Resolution No. 2023-20 approving the employee benefits and salary rates,\nentitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, REGARDING EMPLOYEE BENEFITS AND SALARY\nRATES FOR ALL CLASSES OF EMPLOYMENT”; and\n5. Adopt Resolution No. 2023-22 approving the appropriations limit for Fiscal Year\n2023/24, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA ADOPTING ITS ARTICLE XIIIB APPROPRIATION\nLIMITATION (GANN LIMITATION) FOR FISCAL YEAR 2023/24”; and\n6. Adopt Resolution No. 2023-23 approving the City’s Reserve Policy, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, APPROVING THE CITY OF STANTON RESERVE\nPOLICY FOR FISCAL YEAR 2023/24”; and\n7. AWARD OF A PROFESSIONAL SERVICES AGREEMENT TO YAMADA\nENTERPRISES FOR CONSULTATION, DESIGN, PROCUREMENT AND\nINSTALLATION OF FURNITURE AT THE STANTON FAMILY RESOURCE CENTER\nThe City’s Community Services Department obtained a Community Development Block\nGrant (CDBG) from the County of Orange for renovations to the City’s Family Resource\nCenter. The Department secured additional funding to furnish the facility through\nSupervisor Doug Chaffee’s office. Staff recommends that the City Council authorize the\nCity Manager to enter into an agreement with Yamada Enterprises using a cooperative\npurchasing agreement for procurement and installation of furniture.\nRECOMMENDED ACTION:\n1. City Council declare this project to be categorically exempt under the California\nEnvironmental Quality Act, Section 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment); and\n2. Declare that the Yamada Enterprises quote using a TIPS purchasing contract is in\naccordance with the Purchasing and Contracting Guidelines Section 4.13; and\n3. Approve a Professional Services Agreement with Yamada Enterprises to assist in\nthe procurement and installation of furniture for the Stanton Family Resource Center\nfor the maximum contract sum of $96,800; and\n4. Authorize the City Manager to bind the City of Stanton and Yamada Enterprises in a\ncontract to provide these services.\nJune 13, 2023

FOR SANITARY SEWER AND STORM DRAIN CLEANING\nSERVICES FOR THE CITY OF STANTON\nAs the current contract is set to expire on June 30, 2023, City staff released a Request\nfor Proposal (RFP) soliciting proposals to provide sewer and storm drain cleaning\nservices citywide. Staff recommends awarding a contract to National Plant Services,\nInc.\nRECOMMENDED ACTION:\n1. City Council declare this project to be categorically exempt under the California\nEnvironmental Quality Act, Class 1, Section 15301(c); and\n2. Award a professional service agreement to National Plant Services to provide\nprofessional sewer and storm drain cleaning services for three years in the amount\nnot-to-exceed $1,099,971 or $366,657 annually; and\n3. Authorize the City Manager to bind the City of Stanton and National Plant Services,\nInc. in a contract to provide the services.

AWARD A PROFESSIONAL SERVICE AGREEMENT TO YUNEX LLC FOR TRAFFIC\nSIGNAL AND STREET LIGHT MAINTENANCE SERVICES\nAs the current contract is set to expire on June 30, 2023, City staff released a Request\nfor Proposal (RFP) soliciting proposals to provide traffic signal and street light\nmaintenance services citywide. Staff recommends awarding a contract to Yunex LLC.\nRECOMMENDED ACTION:\n1. City Council declare this project to be categorically exempt under the California\nEnvironmental Quality Act, Class 1, Section 15301(c); and\n2. Award a professional service agreement to Yunex LLC to provide traffic signal and\nstreet light maintenance services for three years in the amount not-to-exceed\n$345,000 or $115,000 annually; and\n3. RESOLUTION ADOPTING THE LIST OF PROJECTS FOR FISCAL YEAR 2023-24\nTO BE FUNDED BY SENATE BILL (SB) 1\nThe proposed resolution approves a list of projects to be funded by SB 1, The Road\nRepair and Accountability Act of 2017, for Fiscal Year 2023-24.\nRECOMMENDED ACTION:\n1. City Council declare that the project is exempt from the California Environmental\nQuality Act (“CEQA”) under Section 15378(b)(5) of the State CEQA Guidelines\nbecause CEQA applies only to projects which have the potential for causing a\nsignificant effect on the environment. Where it can be seen with certainty that there\nis no possibility that the activity in question may have a significant effect on the\nenvironment, the activity is not subject to CEQA; and\n2. Adopt Resolution No. 2023-15, entitled:\n“RESOLUTION ADOPTING A LIST OF PROJECTS FOR THE CITY OF\nSTANTON FISCAL YEAR 2023-24 FUNDED BY SB 1: THE ROAD\nREPAIR AND ACCOUNTABILITY ACT OF 2017”.

RESOLUTION DIRECTING THE AUDITOR-CONTROLLER OF THE COUNTY OF\nORANGE TO ADD THE PROTECTIVE SERVICES TAX TO THE TAX ROLL FOR\nFISCAL YEAR 2023/24\nOn August 6, 1985, the City of Stanton voters approved an initiative measure\nestablishing a Protective Services Tax with a 2/3 majority vote. The proceeds from the\nProtective Services Tax are used for fire protection and suppression services provided\nby the City, which are contracted with the Orange County Fire Authority. Each year, the\nCity Council must adopt a Resolution directing the Auditor-Controller to place this\nassessment on the property tax roll.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or\nreasonably foreseeable indirect physical change in the environment) and\n15060(c)(3) (the activity is not a project as defined in Section 15378(b)(4) of the\nCEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it\nhas no potential for resulting in physical change to the environment, directly, or\nindirectly); and\n2. 9L. PROPOSED CHANGES TO PERSONNEL RULES AND REGULATIONS\nThe City Council has established Personnel Rules and Regulations as set forth in Title\nII, Chapter 2.44 of the Stanton Municipal Code. From time to time the provisions of the\nPersonnel Rules are edited or updated to reflect changes in federal or state law or\norganizational processes and procedures.\nRECOMMENDED ACTION:\n1. City Council declare that this project is exempt from the California Environmental\nQuality Act (“CEQA”) under Section 15378 (b)(2) – continuing administrative or\nmaintenance activities, such as purchases for supplies, personnel-related actions,\ngeneral policy and procedure making; and\n2. Approve Resolution No. 2023-21 amending the City of Stanton Personnel Rules and\nRegulations, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, AMENDING AND ADOPTING PERSONNEL RULES FOR\nTHE ADMINISTRATION OF THE CITY’S PERSONNEL SYSTEM AND\nREPEALING ALL OTHER RESOLUTIONS AND MOTIONS\nINCONSISTENT HEREWITH”.

9M. APPROVE SUBMITTAL OF THE RENEWED MEASURE M ELIGIBILITY PACKAGE\nAND ITS COMPONENTS\nThe Orange County Transportation Authority (OCTA) requires that local jurisdictions\ncomply with a variety of requirements to remain eligible to receive renewed Measure M2\nfunding. The proposed action will approve the submittal of items to keep the City\neligible to receive annual fair share and competitive grant funds. Upon approval by the\nCity Council, the documents will be submitted to OCTA prior to the due date of June 30,\n2023.\nRECOMMENDED ACTION:\n1. City Council find the submittal, adoption, and resolutions exempt from CEQA per\nSection 15378(b)(5) [Project does not include]: organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment; and\nJune 13, 2023\n2. Adopt the Measure M Seven Year Capital Improvement Program (CIP) for fiscal\nyears 2023-24 through 2029-30; and\n3. Adopt Resolution No. 2023-16 concerning the status and update of the Local Signal\nSynchronization Plan for the Measure M (M2) Program, entitled:\n“RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON\nCONCERNING THE UPDATE OF THE LOCAL SIGNAL\nSYNCHRONIZATION PLAN FOR THE MEASURE M (M2) PROGRAM”;\nand\n4. Adopt Resolution No. 2023-17 concerning the status and update of the Master Plan\nof Arterial Highways (MPAH) Consistency and Circulation Element for the Measure\nM (M2) Program, entitled:\n“RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON\nCONCERNING THE STATUS AND UPDATE OF THE CIRCULATION\nELEMENT, AND MITIGATION FEE PROGRAM FOR THE MEASURE M\n(M2) PROGRAM”; and\n5. Adopt Resolution No. 2023-18 concerning the status and update of the Pavement\nManagement Plan for the Measure M (M2) Program, entitled:\n“RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON\nCONCERNING THE STATUS AND UPDATE OF THE PAVEMENT\nMANAGEMENT PLAN FOR THE MEASURE M (M2) PROGRAM”; and\n6. Submit the Maintenance of Effort Reporting Form and supporting documentation for\nthe City of Stanton to OCTA, and direct the Finance Director to certify this form; and\n7. Direct the City Engineer to file the adopted CIP and the Measure M eligibility\ndocuments with OCTA in compliance with the requirements of OCTA Ordinance No.\n3.\nJune 13, 2023

9N. APPROVE THE FISCAL YEAR 2022/23 BUDGET ADJUSTMENT TO REALLOCATE\nTHE CITY’S AMERICAN RESCUE PLAN ACT (ARPA) FUNDS\nThe City received $9,123,660 from the United States Department of Treasury under the\nAmerican Rescue Plan Act of 2021 (ARPA). As of June 6, 2023, the cash balance in the\nCity’s ARPA Fund is $6,479,954. Staff recommends the City Council approve the\nfollowing amendments to the City’s Fiscal Year 2022/23 Budget:\n• Reallocate $6,479,954 of the City’s law enforcement contract services budget\nfrom the General Fund (#101) to the ARPA Fund (#257);\n• Reallocate $1,662,608 of the ARPA Fund’s budget to the General Fund; and\n• Establish an assigned fund balance in the General Fund of $4,817,346 to provide\nfuture funding for projects as approved by the City Council.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment); and\n2. Amend the Fiscal Year 2022/23 total appropriations for the General Fund (#101)\nfrom $23,118,769 to $18,301,423; and,\n3. Amend the Fiscal Year 2022/23 total appropriations for the ARPA Fund (#257) from\n$5,664,981 to $7,807,247; and\n4. Establish an assigned fund balance in the General Fund (#101) of $4,817,346 to\nprovide future funding for projects as approved by the City Council; and\n5. Direct staff to adjust the General Fund Assigned Fund Balance at the close of Fiscal\nYear 2022/23 to adjust the balance to account for any Fiscal Year 2022/23 budget\nsavings resulting from the projects allocated in Attachment C.\nEND OF CONSENT CALENDAR\nJune 13, 2023
