Recommendations for Council action, pursuant to Motion (Rodriguez – McOsker): INSTRUCT the Information Technology Agency to report to the Council in 30 days on the steps needed to embed a Workday Technical expert into the LAPD to better navigate the transition to the Workday software system and correct pay discrepancies. INSTRUCT the LAPD to report to the Council in 30 days on the scale and severity of the problem and corrective actions and support needed to resolve the payroll accounting and payroll system. (32) 19-0468 CD 15 ADMINISTRATIVE AND CATEGORICAL EXEMPTION and TRADE, TRAVEL AND TOURISM COMMITTEE REPORT relative to a proposed Sixth Amendment to Amended and Restated Agreement No. 17-3425-A between the Port of Los Angeles (POLA) and Wabtec Transportation Systems, LLC to enhance the existing Track and Trace and Control Tower modules and implement three new modules for the Port Optimizer Project. Recommendations for Council action: ADOPT the determination by the Board of Harbor Commissioners (Board) that the proposed action is administratively and categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article II, Section 2(f) and Article III, Class 6(2) of the City of Los Angeles CEQA Guidelines. APPROVE the Sixth Amendment to Amended and Restated Agreement No. 17-3425-A between the POLA and Wabtec Transportation Systems, LLC, to increase the not-to-exceed compensation by $6,500,000, from $28,100,420 to $34,600,420, to continue to develop, operate, and support the Port Optimizer Project with no change in the term. CONCUR with Board action on June 7, 2023, by Resolution No. 23-10195, authorizing the Executive Director, POLA, or designee, to execute the proposed Sixth Amendment to Amended and Restated Agreement No. 17-3425-A. Fiscal Impact Statement: The City Administrative Officer reports that approval of the proposed Sixth Amendment to the Amended and Restated Agreement No. 17-3425-A with Wabtec Transportation Systems, LLC will increase the not-to-exceed compensation amount by $6,500,000 for a total not-to-exceed amount of $34,600,420. 2023-2024 funding of $6,500,000 is available within the Harbor Revenue Fund, Information Technology Division, Account 54310 (Information Systems Consulting Services), Center 0640, Program 000. A termination for non-appropriation of funds clause is included in the Agreement. The recommendations in the report comply with the POLA’s Financial Policies. There is no impact on the City's General Fund.

Recommendations for Council action: FIND that the potential issuance of a retail commercial cannabis license, subject to the Department of Cannabis Regulation (DCR) application and licensing processes and compliance with Articles 4 and 5 of Chapter X of the Los Angeles Municipal Code, to Andres Francisco Rigal for Green Qween LLC (Requestor), at 13711 Ventura Boulevard, Los Angeles, California 91423, will serve the public convenience or necessity because of the following reason(s): The existing commercial cannabis businesses in the Requestor’s Community Plan Area are concentrated in one area, such that the Requestor's business, located in another area, would serve the public convenience or necessity. The proposed business premises would serve an area of increased density or consumer traffic, including but not limited to an entertainment or commercial corridor, such that the proposed location would serve the public convenience or necessity by satisfying a higher demand for retail locations. The Requestor's business would include clearly specified public safety related features, such that the operation of the Requestor's business would serve the public convenience or necessity by likely reducing crime or nuisance activity in the surrounding area. GRANT the Request for a Finding of PCN for the proposed retail commercial cannabis business submitted by Requestor, Green Qween LLC, at the proposed business premises address of 13711 Ventura Boulevard, Los Angeles, California 91423. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: DETERMINE the following: Based on the whole of the administrative record, the draft Ordinance is not a project for purposes of CEQA. CEQA does not apply to continuing administrative activities or organizational activities of government that will not result in specific direct or indirect physical changes in the environment, or to the creation of government funding mechanisms or other governmental fiscal activities that do not commit to any specific project that may result in potentially significant environmental impacts. [Public Resources Code Section 21065; State CEQA Guidelines, Sections 15378(b)(2) and (b)(5)]. The draft Ordinance only makes various technical changes to continuing administrative activities, specifically those pertaining to the administrative remedies available for carrying out and enforcing existing building standards. On that basis, the proposed ordinance is not subject to CEQA. Notwithstanding the above, based on the whole of the administrative record, the draft Ordinance is exempt from CEQA under CEQA Guidelines Sections 15301 (categorical exemption for existing facilities), 15308 (Actions by Regulatory Agencies for Protection of the Environment), and Class 21 (Enforcement Actions by Regulatory Agencies); and, that none of the exceptions under Section 15300.2 apply.
