Mayor Pro Tem Van is requesting to discuss\nstrengthening the City’s tobacco retail license ordinance to address any potential\nloopholes, ensure that the definition of both "tobacco retailer" and "flavored tobacco" is\nadequately defined, ensure that the City has an adequate application fee to cover the\ncost of enforcement and monitoring, and methodize compliance monitoring frequencies.\nRECOMMENDED ACTION:\nCity Council provide direction to staff.\nDecember 12, 2023

OCTOBER 2023 GENERAL FUND REVENUE AND EXPENDITURE REPORT;\nHOUSING AUTHORITY REVENUE AND EXPENDITURE REPORT; AND STATUS OF\nCAPITAL IMPROVEMENT PROGRAM\nThe Revenue and Expenditure Report for the month ended October 31, 2023, has been\nprovided to the City Manager in accordance with Stanton Municipal Code Section\n2.20.080 (D) and is being provided to City Council. This report includes information for\nboth the City’s General Fund and the Housing Authority Fund. In addition, this report\nincludes a status of the City’s Capital Improvement Projects (CIP) as of October 31,\n2023. The figures reported represent preliminary figures through October 31, 2023. The\nfiscal year end closing process for Fiscal Year 2022/23 is still in progress and the final\nfigures are pending completion of the City’s annual financial statement audit.\nRECOMMENDED ACTION:\n1. IV-4-2)\nThe City’s Budget Adjustments Policy (Administrative Policy No. IV-4-2) was last\napproved on September 25, 2007, and neither incorporates modern best practices nor\nreflects the City’s current practices. The proposed policy has been updated to be\nconsistent with the authorizations approved by the City Council with the adoption of the\nCity’s annual operating and capital budget (Resolution No. 2023-19).\nRECOMMENDED ACTION:\n1. FISCAL YEAR 2024-2025 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)\nRESOLUTION\nOn November 29, 2023, the Orange County Community Resources Department\nreleased a Request for Applications (RFA) for Fiscal Year 2024-2025 Community\nDevelopment Block Grant projects related to public facilities and improvements (PF&I).\nIn response to the RFA, staff is proposing the Stanton Community/Senior Center\nImprovement Project. As part of the application process, the City Council must review\nand authorize Resolution No. 2023-31 authorizing the City Manager to execute the\nagreement, contract and other documents.\nRECOMMENDED ACTION:\n1. City Council declare that this project is not subject to the California Environmental\nQuality Act (CEQA) because it is not a “project” as defined by CEQA; and\n2. Approve Resolution No. 2023-31 authorizing the City Manager to execute the\nagreement, contract and other documents required by the Orange County\nCommunity Resources Department for participation in the CDBG program on behalf\nof the City Council, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA TO APPROVE THE CITY’S PARTICIPATION IN THE\nFISCAL YEAR 2024-2025 COMMUNITY DEVELOPMENT BLOCK\nGRANT PROGRAM (CDBG) WITH THE COUNTY OF ORANGE”.

AUTHORITY TO ADVERTISE FOR CONSTRUCTION: PREMIER PARK\nRENOVATION PROJECT AND APPROVAL OF CONTRACT AMENDMENT #1 WITH\nRJM DESIGN GROUP\nThe plans and specifications for the Premier Park Renovation Project are complete. The\nCity Engineer is recommending City Council approve the specifications and plans for\nbidding, subject to revision by the City Engineer and the City Attorney, to ensure the\nconstruction contract is awarded in an efficient and timely manner. To ensure\nconstruction of the Project is in conformance with the design, staff is recommending\napproval of a First Amendment to RJM Design Group, Inc.’s to extend the term of their\nAgreement.\nRECOMMENDED ACTION:\n1. City Council find that this project is exempt from the California Environmental Quality\nAct (“CEQA”), Class 1, Section 15301 as an alteration of existing public facility and\nClass 2, Section 15302(c) as reconstruction of existing facility; and\n2. Approve the bid specifications and plans, subject to revisions required by the City\nEngineer and the City Attorney; and\nDecember 12, 2023\n3. Authorize and advertise for bids the Premier Park Renovation Project (Task Code\nNo. 2022-206); and\n4. Approve the First Amendment to the existing agreement with RJM Design Group\nand allow the City Attorney to make minor edits as necessary prior to the execution\nof the Amendment; and\n5. Authorize the City Manager to execute the First Amendment to the existing\nAgreement with RJM Design Group, Inc.

PROFESSIONAL SERVICES AGREEMENTS TO PROVIDE ON-CALL\nGEOTECHNICAL ENGINEERING SERVICES\nOn September 26, 2023, staff released a “Request for Proposals” (RFP) soliciting firms\nto provide professional, on-call geotechnical engineering services in accordance with\nthe City’s Purchasing Policy and Procedures. Staff has pre-qualified four firms and\nrecommends entering into on-call services agreements in the amount of $150,000,\nannually, with each of the pre-qualified firms. Costs associated with work by these firms\nwill be negotiated on a case-by-case basis and funded by each project’s approved\nbudget.\nRECOMMENDED ACTION:\n1. City Council declare this action to be categorically exempt under the California\nEnvironmental Quality Act, since the action herein does not constitute a “project” as\ndefined by section 15378 of the CEQA guidelines; and\n2. Award a contract for professional geotechnical engineering services to GMU\nGeotechnical, Inc., Leighton Consulting, Inc., Ninyo & Moore Geotechnical and\nEnvironmental Sciences Consultants, and Petra Geosciences, Inc. to provide on-\ncall professional geotechnical engineering services in an amount not-to-exceed\n$450,000 or $150,000 annually; and\n3. Authorize the City Manager to bind the City of Stanton and GMU Geotechnical, Inc.,\nLeighton Consulting, Inc., Ninyo & Moore Geotechnical and Environmental Sciences\nConsultants, and Petra Geosciences, Inc. in a contract to provide the services.

6K. AWARD A PROFESSIONAL SERVICES AGREEMENT TO PACIFIC ADVANCED\nCIVIL ENGINEERING, INC. FOR THE STORM DRAIN MASTER PLAN UPDATE\nPROJECT (TASK CODE 2024-801)\nA Storm Drain Master Plan assesses the needs of the City’s storm drain system and\nplans and prioritizes maintenance and rehabilitation of the system with available\nfunding. It also serves as a useful planning tool for the City’s Capital Improvement\nProgram. The previous Storm Drain Master Plan was prepared in 1991 by RBF\nDecember 12, 2023\nConsulting Engineers. Staff released a “Request for Proposal” (RFP) soliciting\nproposals to provide a Storm Drain Master Plan Update to reflect the current condition\nof the storm drain system, assess the capacity of the existing system to handle flows\ngenerated at the ultimate “build-out” of the City, and develop a comprehensive 10-year\nCapital Improvement Program. Staff recommends awarding a contract to Pacific\nAdvanced Civil Engineering, Inc. in the amount of $539,870.\nRECOMMENDED ACTION:\n1. City Council declare this project to be categorically exempt under the California\nEnvironmental Quality Act, Class 1, Section 15301(b) as operation, repair, and\nmaintenance of existing publicly owned utilities; and\n2. Award a professional services agreement to Pacific Advanced Civil Engineering, Inc.\nfor a Storm Drain Master Plan Update in the amount of $539,870; and\n3. Authorize the City Manager to bind the City of Stanton and Pacific Advanced Civil\nEngineering, Inc. in a contract to provide the services; and\n4. Authorize the City Manager to approve a contract contingency, not to exceed ten\npercent of the contract amount, of $53,987.

CONSIDERATION OF ADOPTION OF RESOLUTION IN SUPPORT OF THE\nPALESTINIAN PEOPLE OF GAZA\nAt the November 14, 2023, City Council meeting, Council Member Torres requested\nthat this item be agendized for discussion. Council Member Torres requested to\ndiscuss the creation of a resolution in support of the Palestinian people of Gaza, which\nalso calls for a ceasefire in Israel and occupied Palestine. At the November 28, 2023,\nCity Council meeting, the City Council directed staff to create a staff report and\nresolution for City Council consideration modeling the proposed resolution passed by\nthe City of Cudahy, California.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15378(b)(5)(Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment); and\n2. CONSIDERATION OF EXTENSION OF EXPIRED COMMERCIAL CANNABIS\nPERMITS\nAt the October 24, 2023, City Council meeting, Mayor Shawver requested that a\ndiscussion regarding a review and update of the City’s current cannabis ordinance be\nagendized for discussion. At the November 14, 2023, City Council meeting, per the\ndiscussion, the City Council directed staff to bring back an agenda report focused on the\npossible extension of recently expired cannabis permits.\nRECOMMENDED ACTION:\n1. AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF\nSTANTON, CALIFORNIA ESTABLISHING A TEMPORARY MORATORIUM ON THE\nESTABLISHMENT OF ANY NEW PUBLIC LODGING, LODGING FACILITY OR\nLODGING BUSINESSES OR USES, AND A TEMPORARY MORATORIUM ON ANY\nEXPANSION, ENLARGEMENT, AND/OR ALTERATION OF ANY EXISTING PUBLIC\nLODGING, LODGING FACILITY, OR LODGING BUSINESSES AND USES PENDING\nSTUDY AND THE PREPARATION OF AN UPDATE TO THE CITY’S MUNICIPAL\nCODE AND ZONING CODE PURSUANT TO GOVERNMENT CODE SECTIONS\n65858 AND 36937 AND DETERMINING THE ORDINANCE TO BE EXEMPT FROM\nCEQA\nThe City of Stanton (“City”) has documented that a number of motels in the City are\nmagnets for criminal activity. This is a significant drain on City resources. Each year, the\nCity’s law enforcement responds to hundreds of calls for services that include, among\nother things, prostitution, narcotics violations, stolen vehicles, weapon possession,\nprobation/parole violations, burglary, robbery, gang activity, assaults, and assaults with\ndeadly weapons. That amounts to hundreds of thousands of dollars spent on law\nenforcement, code enforcement, public safety, and other City costs. The high level of\ncriminal activity at motels in the City poses immediate impacts on the health, safety, and\nwelfare of the community. The crime endangers residents, businesses, and visitors, and\nsignificantly degrades quality of life. Against this backdrop, the City Council is asked to\nconsider an interim urgency ordinance to temporarily prohibit the establishment of public\nlodging and/or the expansion, enlargement, or alteration of existing public lodging\nbusinesses and uses within the City. The interim urgency ordinance is intended to\nprovide the City with sufficient time to study the continuing impacts of these\nestablishments and to develop new municipal and zoning code regulations.\nRECOMMENDED ACTION:\n1. City Council find that the proposed urgency ordinance is:\na) Not a “project” within the meaning of Section 15378 of the State of California\nEnvironmental Quality Act (“CEQA”) Guidelines (Title 14 of the California Code of\nRegulations) because it has no potential for resulting in physical change in the\nenvironment, directly or indirectly; and\nb) Exempt from the requirements of CEQA under Section 15061(b)(3) of the CEQA\nGuidelines, as it can be seen with certainty that there is no possibility that the\nactivity in question may have a significant effect on the environment.\n2. Adopt Urgency Ordinance No. 1136, entitled:\n“AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE\nCITY OF STANTON, CALIFORNIA ESTABLISHING A TEMPORARY\nMORATORIUM ON THE ESTABLISHMENT OF ANY NEW PUBLIC\nLODGING, LODGING FACILITY OR LODGING BUSINESSES OR USES,\nAND A TEMPORARY MORATORIUM ON ANY EXPANSION,\nDecember 12, 2023\nENLARGEMENT, AND/OR ALTERATION OF ANY EXISTING PUBLIC\nLODGING, LODGING FACILITY, OR LODGING BUSINESSES AND USES\nPENDING STUDY AND THE PREPARATION OF AN UPDATE TO THE\nCITY’S MUNICIPAL CODE AND ZONING CODE PURSUANT TO\nGOVERNMENT CODE SECTIONS 65858 AND 36937 AND DETERMINING\nTHE ORDINANCE TO BE EXEMPT FROM CEQA”.
