C. 2021 STATE HOMELAND SECURITY PROGRAM GRANT ACCEPTANCE\nThe City of San Gabriel has been awarded grant funds from the 2021 State\nHomeland Security Program (SHSP) for both the San Gabriel Police and Fire\nDepartments in the amount of $119,354 and $62,000 respectively. Both public\nsafety departments are able to use these funds towards projects from the\nDepartment of Homeland Security Approved Equipment List and also to\nprovide training. Funding for the purchases will be reimbursed through the\nState Homeland Security Program grant. Initial outlay would be $181,354, but\nwould be fully reimbursed, with no matching funds. There is no fiscal impact to\nthe General Fund.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council approve the following:\nPolice Department\n1. Increase estimated revenue (account 186-3215) and appropriation\n(transfers out) in ‘Other Grants’ Fund by $119,354; and increase\nestimated revenue (transfers in) and appropriation in Capital/Special\nProjects Funds (account 124-751-57-99-380) by $119,354.\nFire Department\n2. Increase estimated revenue (account 186-3215) and appropriation\n(transfers out) in ‘Other Grants’ Fund by $62,000; and increase estimated\nrevenue (transfers in) and appropriation in Capital/Special Projects\nFunds (account 124-761-57-99-380) by $62,000.\n3. Authorize both the Police Chief and Fire Chief to accept the SHSP grant\nand purchase the items under the City’s purchasing policy.\n4. Authorize the City Manager to execute the subrecipient agreement\nbetween the City and the County of Los Angeles and adopt Resolution\nNo. 23-21 amending the Fiscal Year 2022-2023 Operating Budget.

ORDINANCE NO. 688 AMENDING CHAPTER 130 OF THE SAN GABRIEL\nMUNICIPAL CODE, REGARDING GENERAL OFFENSES, TO ALLOW LOCAL\nPROSECUTION OF CERTAIN MISDEMEANORS – SECOND READING AND\nADOPTION\nAdoption of this Ordinance would modify the San Gabriel Municipal Code to\nadd certain misdemeanor crimes that could be prosecuted locally by the City\nAttorney’s office. ADOPTION OF RESOLUTION NO. 23-27 DECLARING JANUARY 28TH AS\nSTAND AGAINST HATE ACTION DAY\nOn March 9, 2023, the State of California adopted Senate Conforming\nResolution 15 (SCR 15) ;declaring January 28th annually as Stand Against Hate\nAction Day. By adopting the proposed resolution, the City of San Gabriel will\ndeclare January 28th as Stand Against Hate Action Day, calling upon the\ncommunity to collectively denounce hate and celebrate inclusion. There is no\nfiscal impact related to this item.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 23-27 declaring\nJanuary 28th annually as Stand Against Hate Action Day.

SECOND AMENDMENT TO AGREEMENT WITH THE SAN GABRIEL VALLEY\nCOUNCIL OF GOVERNMENTS (SGVCOG) TO PARTICIPATE IN THE SAN\nGABRIEL VALLEY REGIONAL VEHICLE MILES TRAVELED (VMT) ANALYSIS\nMODEL AND TOOL UPDATE\nThe Community Development Department is requesting a second amendment\nto an existing professional services agreement with the San Gabriel Valley\nCouncil of Government (SGVCOG) to participate in the San Gabriel Valley\nRegional Vehicle Miles Traveled (VMT) Analysis Model and Tool Update at an\nadditional cost of $15,000 for a five-year term. San Gabriel is one of 26 cities to\nparticipate in the regional program to have access to a web-based\ntransportation screening tool for development projects for California\nEnvironmental Quality Act (CEQA) purposes. Funding will be proposed as part\nof the Fiscal Year 2023-2024 budget in account No. 184-800-00-22-000.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council approve an amendment to an existing\nMemorandum of Agreement (MOA) with the San Gabriel Valley Council of\nGovernment for an amount not to exceed $15,000.00 for the implementation\nof the San Gabriel Vehicle Miles Traveled (VMT) Analysis Model & Tool Update.

HUMAN, EQUITY, ACCESS AND RELATIONS COMMISSION PROPOSED\n2023 ANNUAL WORKPLAN\nThis is the 2023 calendar Annual Work plan developed by the Human Equity,\nAccess and Relations Commission for the 2023 calendar year to best fit in\nalignment with the goals and scope of the HEAR Commission as well as the City\nof San Gabriel’s Mission. The workplan includes a request of $2,500 for the\nMental Wellness Expo in October. Should Council approve the request, this will\nrequire $2,022.82 from the General Fund and $477.18 remaining funds from the\nSan Gabriel Community Foundation Grant received by the City in 2022.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council review and approve the HEAR\nCommission’s Annual Workplan, as presented, for 2023.

ACCEPTANCE OF ASSISTANCE TO FIREFIGHTERS GRANT AWARD AND\nPURCHASE OF WASHER-EXTRACTOR AND DRYER CABINET IN THE\nAMOUNT OF $37,059.77\nThe San Gabriel Fire Department has been awarded funds from the 2021\nAssistance to Firefighter Grant (AFG) Program in the amount of $33,690.70. The\nFire Department is recommending Council’s adoption of Resolution No. 23-24\nand authorization for the City Manager to issue purchase orders for the\nacquisition of a washer-extractor and drying cabinet as detailed in the report.\nThis is a United States Homeland Security AFG Program managed by Federal\nEmergency Management Agency. The total outlay would be $37,030.21. The\ngrant will pay for $33,663.83 and the general fund is obligated to a matching\namount of $3,366.38. The deadline to use these funds is August 29, 2024.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council\n1. Adopt Resolution No. 23-24 accepting the grant and appropriation.\n2. Increase the appropriations in the Fire Department special project grant\naccount by $33,690.70, account #124-761-57-99-390.\n3. A. SMITH PARK RESOURCE DISCUSSION - PICKLEBALL\nDuring the July 18, 2022 Community Services Commission meeting, staff\npresented the community’s request to build pickleball courts at Smith Park.\nAfter much deliberation and public comment provided by the community, the\nCommission recommended that staff present a proposal to the City Council to\nadd four new permanent pickleball courts at Smith Park. Staff have researched\nthe costs associated with the construction of new courts including laying\nconcrete, lighting, fencing with wind screens, walkways, surfacing, and striping\nand have included estimates in this report. Staff propose the use of existing\nPark Impact Fees for the implementation of the new pickleball courts because\nthis is a qualifying expansion to the public amenities. The total cost shall not\nexceed $180,000. Council has previously approved $30,000 additional funds\nfrom the Tennis Special Activities Fund in Fiscal Year 2022-2023 to resurface\nand restripe the existing courts.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council review the proposal to construct four\nnew permanent pickleball courts and approve the funding request necessary to\nimplement the project.

B. DISCUSSION ON THE TAXPAYER PROTECTION AND GOVERNMENT\nACCOUNTABILITY ACT BALLOT INITATIVE – REQUEST FOR DIRECTION ON\nAN OFFICIAL CITY POSITION AND CONSIDERATION OF ADOPTION OF A\nRESOLUTION NO. 23-28 EITHER IN SUPPORT OF OR IN OPPOSITION TO\nTHE BALLOT INITIATIVE\nA ballot initiative called the Taxpayer Protection and Government\nAccountability Act was created and sponsored by several taxpayer protection\ngroups, and gathered sufficient signatures to qualify for placement on the\nNovember 2024 election. Staff is seeking direction on an official City position\non the ballot initiative and consideration of a resolution establishing the City’s\nposition on the measure. There is no fiscal impact associated with discussing\nthe City’s position on the ballot initiative. The potential financial effects of the\nballot measure, should it be successful, are difficult to estimate, those in favor\nof the initiative suggest that the initiative will save taxpayers millions of dollars,\nand those opposed to the initiative suggest that the measure will cost cities\nmillions of dollars in lost revenue.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council discuss the Taxpayer Protection and\nGovernment Accountability act and if desired, adopt Resolution No. 23-28\nsupporting the Supporting Taxpayer Protection and Government\nAccountability Act.

APPOINTMENTS TO THE CIVIL SERVICE, COMMUNITY SERVICES, DESIGN\nREVIEW, HISTORIC PRESERVATION AND CULTURAL RESOURCE, AND\nPLANNING COMMISSIONS\nOn April 26 and 27, 2023, the City Council conducted interviews for the above-\nnamed Commissions for vacancies with terms ending May 31, 2023. The Council\nis requested to consider appointments to the Commissions for both scheduled\nand unscheduled vacancies, and for a waitlist. There is no fiscal impact related\nto this item.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council appoint Commissioners for scheduled\nand unscheduled vacancies on the Civil Service, Community Services, Design\nReview, Historic Preservation and Cultural Resource, and Planning\nCommissions, and select individuals they would like to add to the waitlist\nshould any unscheduled vacancies arise.
