The League would like each member city to\nestablish a position on the resolution prior to the annual meeting and provide\ndirection to the voting delegate. The City Council appointed Mayor John Wu as\nthe Delegate and Councilmember Tony Ding as the Alternate to serve as the\nCity’s voting delegate to the League of California Cities. ORDINANCE NO. 713 AMENDING TITLE III, SECTION 34 OF THE SAN\nGABRIEL MUNICIPAL CODE – FINANCE AND REVENUE – SECOND\nREADING AND ADOPTION\nThe proposed ordinance would amend Title III, Section 34 of the San Gabriel\nMunicipal Code. The ordinance would amend, in part, the dollar thresholds\nrequired for formal and informal contract procedures as well as the City\nManager authority to make purchases, increasing the amounts from $15,000 to\n$25,000. The ordinance would also amend the amount required to obtain three\ninformal written bids from $3,000 to $5,000 and propose some minor text\nchanges. The first reading of the proposed ordinance was conducted on August\n20, 2024. There is no fiscal impact for this item. F. 2024 CONFLICT-OF-INTEREST CODE BIENNIAL UPDATE [RESOLUTION NO.\n24-61]\nUnder the Political Reform Act, public agencies are required to adopt a conflict-\nof-interest code designating positions required to file Statements of Economic\nInterests (Form 700) and assigning disclosure categories specifying the types of\ninterests to be reported. The conflict-of interest code must be reviewed every\nCity Council Regular Meeting Agenda – September 17, 2024 4\ntwo years so that amendments may be made as needed. ORDINANCE NO. 711: APPROVING A GENERAL PLAN AMENDMENT,\nZONE CHANGE, ZONE TEXT AMENDMENT, AND LOT LINE ADJUSTMENT\nFOR A CEMETERY EXPANSION PROJECT AT 607 WEST ROSES ROAD\n(GPA21-001, ZC21-001, ZTA21-001 AND LTLA21-009) – SECOND READING\nAND ADOPTION\nOrdinance No. 711 was approved at introduction by a 5-0 vote of the City\nCouncil at the August 20, 2024, City Council meeting. If adopted, this Ordinance\nwill amend the General Plan Land Use, Zoning, Zone Text Amendment, and Lot\nLine Adjustment for a cemetery expansion project at 607 W. Roses Road. If\nadopted, the Ordinance would become effective 30 days after adoption. The\nFiscal Year 2023-2024 Adopted Budget includes the cost for required legal\npublication (Account No. 121-702-00-65-000) and codification (Account No.\n121-702-00-22-000) of the ordinance.\nCalifornia Environmental Quality Act (CEQA) Determination: According to the\nCalifornia Environmental Quality Act (CEQA) and CEQA Guidelines, discretionary\nprojects are subject to environmental review. Following preliminary review, an\ninitial study was prepared to determine if the project may have a significant effect\non the environment. H. DIGITAL COPY MACHINE 5-YEAR LEASE PROPOSAL IN THE AMOUNT OF\n$621.25 PER MONTH\nThe San Gabriel Police Department (SGPD) entered into a five-year lease\nagreement in April 2019 with Canon Solutions America, Incorporated for three\nof the current SGPD copiers. This lease agreement expired in June 2024, and\nSGPD has been on a month-to-month basis since that time. Funds for the digital\ncopier services currently budgeted in the Police Department’s Contractual\nExpenditure Account No. 121-751-00-22-000 under ‘Copier and Maintenance,’\nare set at $21,400. Since an anticipated cost savings would occur through this\nnew lease agreement, additional funds into the contractual account would not\nbe necessary. The identified expenditure includes preparation, delivery,\ninstallation, training, maintenance, service/labor, parts and toner charges. The\nexpenditure does not includes taxes, paper, or the cost per print/copies.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nCanon and the products identified in this report have already been through the\ncompetitive bid process with the OMNIA Partners, Public Sector, Contract No.\n2020002755. Staff recommends that the City Council waive the formal\ncompetitive bidding procedure and authorize the City Manager to utilize the\ncooperative discount pricing to obtain a new lease of $621.25 per month, for\nfour copiers for a period of five-years.

I. FIVE-YEAR SERVICE AGREEMENT FOR DISPATCH SERVICES WITH\nVERDUGO FIRE COMMUNICATIONS\nThe San Gabriel Fire Department has utilized Verdugo Fire Communications\nCenter for dispatch services since 2000. As the last Service Agreement expired\non June 30, 2024, the Fire Department requests approval of a new, five-year\nagreement for Dispatch Services. The proposal is a five-year agreement with\nthe provision for two, three-year extensions. The City of San Gabriel pays $84.18\nper incident dispatched (regardless of many units respond) and for Fiscal Year\n2024-2025, the total cost is estimated to be $229,135.00 based on an estimate\ncall volume of 2,722 unique incidents. An increase of 5% per year is assumed\nand part of the contract, although as more cities have come into Verdugo, this\nincrease has not been implemented in the past two fiscal years. Funding for\nCity Council Regular Meeting Agenda – September 17, 2024 6\nthese services will come from the General Fund Fire Department budget and\nare included in the adopted Fiscal Year 2024-2025 operating budget.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council authorize the City Manager and Fire\nChief to execute the Verdugo Fire Communications Service Agreement.

J. FIREWORK DISPLAY PERMIT – GABRIELINO HIGH SCHOOL\nFireworks & Stage FX America, on behalf of Gabrielino High School, has made\napplication to the San Gabriel Fire Department for a Fireworks permit to\nconduct a fireworks display on school property on October 18, 2024. The\ndisplay is to begin at 8:00 P.M. and last for approximately two minutes. Pursuant\nto San Gabriel Municipal Code Title IX, Sections 96.21 – 96.23, City Council\napproval is required to issue a permit on approval and recommendation of the\nFire Chief for pyrotechnic displays. A fee of $81 is due at the time of permit\nissuance per the Fiscal Year 2024-2025 Master Fee Schedule. No Fire\nDepartment overtime expense is anticipated for this event.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council authorize the Fire Chief or Deputy Fire\nMarshal to issue a Fireworks Permit to Fireworks & Stage FX America, on behalf\nof Gabrielino High School, contingent on meeting the conditions of the\napplication.

K. UPFIT OF A FIRE DEPARTMENT STAFF VEHICLE IN THE AMOUNT OF\n$32,984.60\nThe San Gabriel Fire Department, as part of its emergency response fleet,\nmaintains a vehicle for the Fire Chief to use for emergency response, and official\nbusiness. As the demand for Fire Department services increases and major\nincidents require greater command oversight, staff has developed a plan to\nincrease the response capacity of the Fire Chief vehicle to include basic Incident\nCommand capability, at a cost substantially less than the acquisition and build\nof a second dedicated Command Vehicle. This project has a cost of $32,984.60,\nCity Council Regular Meeting Agenda – September 17, 2024 7\nwhile the cost to acquire and equip a dedicated command vehicle is over\n$210,000. Funding for the project will come from the General Fund Fire\nDepartment budget, and although not a specific purchase at the time of budget\ncreation, existing allocations are sufficient to complete this project.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council approve the issuance of a purchase\norder in the amount of $32,984.60 to 911 Vehicle, Incorporated for the upfit\nproject.

L. RESOLUTION NO. 24-49 APPROVING THE SIDE LETTER OF AGREEMENT\nWITH THE SAN GABRIEL POLICE OFFICERS’ ASSOCIATION\nRepresentatives of the City and San Gabriel Police Officers’ Association (POA)\nmutually desire to improve the recruitment and retention of Police Officers and\nhave agreed to amend the standing Memorandum of Understanding (MOU) to\nmake education incentive and senior officer pay available to qualifying\ncandidates for Police Officer upon hire. The amended provisions shall have no\nretroactive applications or impact. Amending education incentive pay and\nsenior officer pay as recommended will have a cost impact of approximately\n$45,000 for Fiscal Year 2024-2025, of which $24,000 (53.3%) is attributed to\ncurrent to the anticipated increase in starting compensation for new hires made\nover the remainder of Fiscal Year 2024-2025. An Additional appropriation of\n$40,000 in General Funds is needed to cover the anticipated increase in police\npersonnel salaries for Fiscal Year 2024-2025.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 24-49, which\napproves the Side Letter of Agreement amending the standing MOU between\nthe City and POA and authorizes the City’s negotiators to execute the Side\nLetter of Agreement and increases General Fund appropriations $45,000 to\ncover increased costs to police personnel salaries for Fiscal Year 2024-2025.\nCity Council Regular Meeting Agenda – September 17, 2024 8

REQUEST TO ACCEPT $10,000 DONATION FROM DESERT COMMUNITY\nFOUNDATION AND PURCHASE WURLITZER BRASS TRUMPET RANK\nThe San Gabriel Mission Playhouse is home to one of the Finest Wurlitzer\nTheatre Pipe Organ installations in the country. When the Playhouse first\nreceived the organ, it did not have its original Wurlitzer Brass Trumpet Set,\nconsisting of 61 pipes. Rather, it had a Godfrey Trumpet set. With the help of\nMr. Peter Lloyd Crotty, a well-known expert within the exclusive circle of\nWurlitzer restoration specialists, an original 1920’s restored set of Wurlitzer\nBrass Trumpet pipes has been located from Century Pipe Organs in\nMinneapolis, MN. The generous donation from the Desert Community\nFoundation of $10,000 will completely cover the cost of the 8’ Wurlitzer Brass\nTrumpet Rank (61 pipes), as well as the shipping cost from Century Pipe Organs.\nThere will be no additional installation cost as the installation will be done in\nhouse by Josh Fairman and expert Wurlitzer restoration volunteers.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council accept the donation of $10,000 from\nthe Desert Community Foundation into the Donation Account No. 152-329 to\nbe transferred to the Expenditure Account No. 124-712-35-96-840. Staff further\nrecommends, noting the unique nature of this project and rarity of the\nequipment needed, that the City Council waive the formal bid process and\nauthorize the purchase of the Brass Trumpet Rank from Century Pipe Organs.\nThis would be consistent with the San Gabriel Municipal Code Section 34.35 C,\nwhich exempts certain specialty items from the normal procurement policies.

N. SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP) GRANT APPROVAL\nThe Police Department has received a renewal grant from the Office of Traffic\nSafety (OTS) to participate in the Selective Traffic Enforcement Program (STEP)\nfor Federal Fiscal Year 2024-2025. The grant will reimburse the City for\npersonnel overtime costs incurred in participating in this campaign and for\npurchase of related equipment for training in the sum of $175,000. This report\nseeks Council’s approval of the Resolution which would authorize acceptance\nof the grant funding and amend the current budget approving the allocation\nof funds not to exceed the amount of $175,000 to be reimbursed by OTS based\non actual funds used during the Federal Fiscal Year grant (10-01-2024 through\n09-30-2025).\nCity Council Regular Meeting Agenda – September 17, 2024 9\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 24-50 approving\nand accepting the Office of Traffic Safety contract funding outlined in this Staff\nReport and increase the Revenue Budget Account No. 147-3229 by an\nestimated $175,000 to reflect receipt of the grant funds and increase\nappropriations in the Police Department Expenditure Budget by $175,000,\naccount 147-751-00-11-000 cost center, which will be used to account for the\ngrant expenditures. The Office of Traffic Safety grant fund revenue budget\nestimate will increase by $175,000 with a corresponding increase in the\nexpenditure budget of $175,000.

ORDINANCE NO. 710 AMENDING THE VALLEY BOULEVARD SPECIFIC\nPLAN RELATING TO GROUND FLOOR OFFICE USE AND ESTABLISHING\nMINIMUM DENSITIES (SPA24-001) – INTRODUCTION AND FIRST\nREADING\nThe proposed Valley Boulevard Specific Plan Amendment would amend the\nSpecific Plan relating to ground floor office use and establish minimum\ndensities intended to implement the goals and programs identified in the 2021-\n2029 Housing Element. The Fiscal Year 2023-2024 Adopted Budget includes the\ncost for required legal publication (Account No. 121-702-00-65-000) and\ncodification (Account No. 121-702-00-22-000) of the ordinance.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\namendments were reviewed for compliance with the California Environmental\nQuality Act (CEQA). An Initial Study/Negative Declaration (IS/ND) was prepared\nfor the 2021-2029 Housing Element, as required by the California Environmental\nQuality Act (CEQA), Public Resources Code (PRC) Section 21000 et seq., the CEQA\nGuidelines, and the City of San Gabriel Local Guidelines for Implementing CEQA.\nThe IS/ND considered the policies and programs outlined in the Housing Element.\nThe Housing Element establishes objectives, policies, and programs to assist the\nCity in achieving state-mandated housing goals. No formal land use changes or\nphysical development are proposed at this time and future land use and physical\ndevelopment would require separate environmental evaluation.\nCity Council Regular Meeting Agenda – September 17, 2024 10\nRecommended Action:\nStaff recommends that the City Council:\n1 . Conduct the public hearing and discuss proposed Ordinance No. 710;\n2 . A. CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH\nFARM HABITS FOR THE CERTIFIED FARMER’S MARKET AND BUDGET\nAPPROPRIATION OF $25,000 FOR MARKETING AND EQUIPMENT\nIn late April, the City and Supporting arms launched the San Gabriel Farmer’s\nMarket. Despite many efforts, the Farmer’s Market was not able to consistently\nretain vendors, and attendance to the vent decreased. At the August 20, 2024,\nCity Council meeting, the City Council directed staff to return with an\nagreement to onboard Farm Habits as the new farmer’s market operator. The\ncouncil determined that the closure of Mission Drive adjacent to Blossom\nMarket Food Hall would be the best location to relaunch the market and to host\nthe market on Saturday mornings. The intent of this report is to present the City\nCouncil with the draft agreement with Farm Habits for consideration and\napproval and to discuss the next step towards relaunching the farmer’s market.\nTo meet the staff recommended $25,000 budget for the event, and additional\n$4,000 will need to be appropriated to the Fiscal Year 2024-2025 budget for\nthis special event. The fee waiver, if approved, would reduce the potential\nrevenue by $3,237.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council:\nCity Council Regular Meeting Agenda – September 17, 2024 11\n1. A. REPORT AND RECOMMENDATIONS FROM CITY COUNCIL AD HOC\nSUBCOMMITTEE\nThe City Council appointed an ad hoc subcommittee consisting of Vice Mayor\nMenchaca and Councilmember Ding to analyze and identify policies or\nprograms that could be implemented to support the LGBTQ+ community. The\nad hoc subcommittee met with several stakeholders and had identified a short\nlist of recommendations for the City Council to consider. There are no fiscal\nimpacts associated with receiving this report from the City Council ad hoc\nsubcommittee. Any subcommittee recommendations resulting in fiscal impacts,\nthat the City Council directs for implementation that are not already included\nin the current fiscal year budget will be brought back at a future date for\nconsideration. HEDGE HEIGHT DISCUSSION\nAt the July 2, 2024 City Council meeting, during the public comment portion of\nthe meeting a comment was provided for the City to consider reviewing its\nhedge height regulations in the residential zones to either allow for additional\nheights or to not regulate hedge heights. This report serves as a follow-up to\nthe City Council’s direction to agendize the matter of hedge height for City\nCouncil discussion. There is no fiscal impact.
